Pursuant to Clause 1, Article 8 of Decree 144/2021/ND-CP, administrative penalties for ensuring public tranquility are stipulated as follows:
- A warning or a fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for one of the following acts:
a) Creating loud noises, causing disruption, and public nuisance in residential areas or public places from 10:00 PM of the previous day to 6:00 AM of the following day;
b) Failing to comply with regulations on maintaining tranquility in medical examination and treatment facilities, convalescent homes, schools, or other places where general tranquility is required;
c) Selling food and beverages beyond the prescribed hours set by the People's Committee of the province or centrally-run city.
According to current regulations, singing karaoke at midnight is considered an act of creating loud noises, causing disruption, and public nuisance in residential areas or public places. This act shall be subject to a fine ranging from VND 500,000 to VND 1,000,000.
How much is the fine for using loudspeakers to cause noise for promotion without permission from competent authorities?
Pursuant to Clauses 2 and 3, Article 8 of Decree 144/2021/ND-CP, administrative penalties for ensuring public tranquility are stipulated as follows:
A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed for the act of using loudspeakers, gongs, drums, whistles, horns, or other means to promote in public places without permission from competent authorities.
Additional form of penalty:
Confiscation of the objects and means of administrative violation for the act of violating the provisions in Clause 2 of this Article.
Thus, the act of using loudspeakers to cause noise for promotion without permission from competent authorities shall be subject to a fine ranging from VND 1,000,000 to VND 2,000,000. Additionally, the objects and means of violation shall be confiscated.
