Based on Article 257 of the 2015 Criminal Code, regulations regarding the crime of forcing others to use narcotic substances are outlined as follows:

  1. Anyone who uses force, threatens the use of force, or employs other methods to coerce others's spirit to compel them to use narcotic substances against their will, shall be sentenced to imprisonment from 02 years to 07 years.

  2. Committing the crime under one of the following circumstances shall result in a sentence of 07 years to 15 years of imprisonment:

    a) Organized manner;

    b) Committing the crime 02 times or more;

    c) For a despicable motive or for personal gain;

    d) Against a person aged 13 to under 18 years old;

    dd) Against a woman known to be pregnant;

    e) Against 02 or more persons;

    g) Against a person undergoing drug detox;

    h) Causing harm to another’s health with a body injury rate from 31% to 60%;

    i) Causing a dangerous disease to others;

    k) Dangerous recidivism.

  3. Committing the crime under one of the following circumstances shall be punishable by 15 years to 20 years of imprisonment:

    a) Causing harm to another’s health with a body injury rate of 61% or more or causing death;

    b) Causing a dangerous disease to 02 or more persons;

    c) Against a person under 13 years of age.

  4. Committing the crime resulting in the death of 02 or more persons shall be punishable by 20 years of imprisonment or life imprisonment.

  5. The offender may also be subject to a fine ranging from 5,000,000 VND to 100,000,000 VND.

Depending on the degree of the offender's crime in coercing your sibling to use narcotic substances, the competent Court will issue a corresponding penalty based on the above regulations. The minimum punishment for this act is imprisonment from 02 years to 07 years.

Vietnam: If a person is coerced into using narcotic substances and causes damage, do they have to compensate?

Based on Article 596 of the 2015 Civil Code, regulations regarding compensation for damage are as follows:

  1. A person who, due to drinking alcohol or using other stimulants, loses the ability to perceive or control their actions and causes damage to others, must compensate.

  2. When one person intentionally uses alcohol or other stimulants to make others lose the ability to perceive or control their actions and causes damage, the person who caused the state must compensate the injured person.

Thus, according to the above regulations, your sibling will not have the responsibility to compensate for the damage. The person who forced your sibling to use narcotic substances will have the responsibility to compensate.
