Research and implementation of traffic violation fines payment on VNeID application in Vietnam

On September 10, 2023, the Vietnamese government issued Resolution 144/NQ-CP in 2023 on the regular government meeting in August 2023.

As prescribed, one of the notable contents that the government requires the Ministry of Transport to implement is to:

Prioritize and coordinate with relevant agencies and localities to research the integration of driver's licenses to pay traffic violation fines on VNeID.

At the same time, research and implement the payment of traffic violations under the authority of traffic inspectors on VNeID.

Accelerate the progress of strategic, important national transportation projects, and projects with interregional characteristics.

- Coordinate with the Ministry of Natural Resources and Environment, relevant agencies and localities to ensure the supply of sufficient construction materials for key and important national projects.

- Coordinate with relevant agencies and localities to focus on reviewing and investing to complete the access roads and connecting intersections to maximize the effectiveness of the high-speed routes that have been put into operation. Urgently develop a set of standards for highways to be submitted to the competent authority for issuance in October 2023.

What are procedures for payment of traffic violation fines in Vietnam?

Pursuant to Clause 2 Article 20 of the Decree 118/2021/NĐ-CP stipulating procedures for payment of traffic violation fines in Vietnam as follows:

Step 1: In the case where the decision to impose a fine applies only to a fine, and the individual being fined does not reside or the organization being fined does not have its headquarters at the place where the violation occurred, then:

At the request of the individual or organization being fined, the person authorized to impose the fine decides to pay the fine by transferring money to the account of the State Treasury as stated in the decision to impose the fine through the National Public Service Portal or electronic payment services of the bank or organization providing intermediary payment services.

At the same time, send the decision to impose a fine to the individual or organization in violation by post in a secure manner within 2 working days from the date of issue of the decision to impose a fine;

Step 2: The individual or organization being fined pays the fine to the State Treasury account stated in the decision to impose the fine within 10 days from the date of receipt of the decision to impose a fine for administrative violations;

In case the decision to impose a fine for administrative violations has a longer execution period than 10 days, then it will be implemented according to that period.

Step 3: Within 5 working days from the date the fine is paid directly into the account of the State Treasury or indirectly through public postal services:

The person who temporarily holds the documents to ensure the implementation of the penalty under the provisions of Clause 6, Article 125 of the 2012 Law on Handling Administrative Violations must return the documents that have been temporarily held to the individual or organization being fined via post in a secure manner for the case of direct payment or sent via public postal services for the case of indirect payment.

The costs of sending the decision to impose a fine and the costs of returning the documents are paid by the individual or organization being fined;

What are methods of payment of traffic violation fines in Vietnam?

Pursuant to Clause 1 Article 20 of the Decree 118/2021/NĐ-CP stipulating methods of payment of traffic violation fines in Vietnam as follows:

Form 1: Pay in cash directly at the State Treasury or at a commercial bank where the State Treasury has an account as stated in the decision to impose a fine;

Form 2: Transfer money to the account of the State Treasury as stated in the decision to impose a fine through the National Public Service Portal or electronic payment services of a bank or intermediary payment service provider;

Form 3: Pay the fine directly to the person authorized to impose the fine as stipulated in Clause 1 Article 56 and Clause 2 Article 78 of the Law on Handling Administrative Violations in 2012; or

Form 4: Pay directly to the port authority or representative of the airport authority for the case where the person being fined is a transit passenger through Vietnamese territory to carry out an international flight departing from Vietnamese territory; crew members on duty on a transit flight through Vietnamese territory; crew members of foreign airlines operating an international flight departing from Vietnamese territory;

Pay traffic violation fines in the field of road traffic to the State Treasury according to the above 3 forms or through public postal services.
