Receiving a Decision for Traffic Violations: When Should the Fine Be Paid?
According to the information you provided, you were caught speeding on a motorbike by 18 km/h. Based on the regulations at Point a Clause 4 Article 6 of Decree 100/2019/ND-CP:
The operator of a motorbike exceeding the speed limit by 10 km/h to 20 km/h will be fined from 600,000 VND to 1,000,000 VND.
Thus, when driving a motorbike exceeding the speed limit by 11 km/h, the fine applicable in this case ranges from 600,000 VND to 1,000,000 VND.
Additionally, Clause 2 Article 78 of the 2012 Law on Handling Administrative Violations stipulates:
Within 10 days from the date of receiving the penalty decision, the individual or organization that is penalized must pay the fine at the State Treasury or into the account of the State Treasury indicated in the penalty decision, except in cases where the fine has been paid as stipulated in Clauses 2 and 3 of this Article. If the deadline is exceeded, enforcement measures will be applied, and for each day late in paying the fine, the violating individual or organization must pay an additional 0.05% of the total unpaid fine.
Based on the above provisions, after receiving the penalty decision, the enforcement period for the penalty decision is 10 days. Unless the penalty decision specifies a period longer than 10 days, in which case, the specified period will be followed.
Kind regards!
