Proposal: Motorcycles carrying 3 people will not be fined in case of carrying the elderly or disabled in Vietnam

According to the new proposal in Vietnam, is it correct that motorcycles carrying 3 people will not be fined in case of carrying the elderly or disabled? - Mr. Truong (Binh Duong).

Proposal: Motorcycles carrying 3 people will not be fined in case of carrying the elderly or disabled in Vietnam

Pursuant to Article 30 of the Law on Road Traffic in 2008 stipulating as follows:

Operators of and passengers on motorcycles and mopeds

1. The operator of a motorcycle or moped may carry only one person, except for the following cases in which carrying two persons at most is permitted:

a/ Carrying sick persons for emergency medical treatment;

b/ Escorting a person who has committed an illegal act;

c/ Carrying children under 14 years of age.

Article 31 of the Draft Law on Road Traffic Order and Safety proposes that motorcycles are allowed to carry three people in the following cases:

Drivers and passengers of motorcycles, mopeds, and similar vehicles

1. Drivers of two-wheeled motorcycles, mopeds, and similar vehicles may only carry one passenger, except in the following cases, where they may carry up to two passengers:

a. To transport a sick person to the emergency room;

b. To transport a person who has committed a violation of the law;

c. To transport a child under 14 years of age;

d. To transport an elderly person or a person with a disability.

2. Drivers and passengers of two-wheeled motorcycles, three-wheeled motorcycles, mopeds, and similar vehicles must wear the correct type of helmet for motorcycle riders and fasten the strap correctly.

Therefore, the new draft would add two cases in which motorcycles are allowed to carry three people without being fined: transporting an elderly person and transporting a person with a disability.

According to the new proposal in Vietnam, what acts shall not be done by motorcycle riders?

Pursuant to Clause 3 Article 30 of the Law on Road Traffic in 2008 stipulating as follows:

Drivers and passengers of motorcycles

3. Operators of motorcycles, three-wheeled motor vehicles or mopeds are prohibited from:

a/ Traveling abreast;

b/ Traveling in road sections reserved for pedestrians and other vehicles;

c/ Using umbrellas, mobile phones and audible devices, except hearing aids;

d/ Pulling and pushing other vehicles or objects, and carrying bulky objects;

e/ Operating the vehicle without holding the handlebars or on one wheel, for two-wheeled vehicles, or on two wheels, for three-wheeled vehicles;

f/ Other acts badly affecting traffic order and safety.

Clause 3 Article 31 of the Draft Law on Road Traffic Order and Safety proposes that Motorcycle drivers are not allowed to do the following acts:

Drivers and passengers of motorcycles, mopeds, and similar vehicles

...

3. Motorcycle drivers are not allowed to do the following:

a) Riding in a line;

b) Riding on the sidewalk or on the lane for other vehicles;

c) Using an umbrella;

d) Letting go of both hands or riding on one wheel for a two-wheeled motorcycle, or on two wheels for a three-wheeled motorcycle;

dd) Using the motorcycle to tow, push, or carry other vehicles, objects, or animals, lead animals, carry bulky items; carry people standing on the motorcycle, load carrier or sit on the handlebars; overload the motorcycle;

e) Sitting on one side of the motorcycle to control the vehicle; standing, lying on the motorcycle to control the vehicle; changing drivers while the vehicle is running; turning around to look back to control the vehicle or covering the eyes to control the vehicle; using the kickstand or other objects to drag on the road while the vehicle is running;

g) Any other behavior that disrupts traffic order and safety.

Therefore, the draft law is expected to amend and add some new cases that motorcycle drivers are not allowed to do, including:

- Riding in a line;

- Riding on the sidewalk or on the lane for other vehicles;

- Using an umbrella;

- Letting go of both hands or riding on one wheel for a two-wheeled motorcycle, or on two wheels for a three-wheeled motorcycle;

- Using the motorcycle to tow, push, or carry other vehicles, objects, or animals, lead animals, carry bulky items; carry people standing on the motorcycle, load carrier or sit on the handlebars; overload the motorcycle;

- Sitting on one side of the motorcycle to control the vehicle; standing, lying on the motorcycle to control the vehicle; changing drivers while the vehicle is running; turning around to look back to control the vehicle or covering the eyes to control the vehicle; using the kickstand or other objects to drag on the road while the vehicle is running;

- Any other behavior that disrupts traffic order and safety.

In Vietnam: Can people on motorbikes use umbrellas when it rains?

Pursuant to Clause 4 Article 30 of the Law on Road Traffic in 2008 stipulating as follows:

4. Passengers of motorcycles, three-wheeled motor vehicles or mopeds in traffic are prohibited from:

a/ Carrying bulky objects;

b/ Using umbrellas;

c/ Clinging to, pulling or pushing other vehicles;

d/ Standing on the saddle or pillion, or sitting on the handlebars;

e/ Other acts baldy affecting traffic order and safety.

As regulations above, people on motorbikes cannot use umbrellas when it rains.

Note: The Draft Law on Road Traffic Order and Safety is in the process of collecting comments and has not yet taken effect.
