Pregnant Women Who Violate Traffic Laws: Are Their Penalties Reduced?
Section 4, Article 23 of the 2012 Law on Handling Administrative Violations stipulates:
- The specific fine for an administrative violation is the average of the fine bracket prescribed for that violation;
- If there are mitigating circumstances, the fine may be reduced but not below the minimum level of the fine bracket;
If there are aggravating circumstances, the fine may increase but not exceed the maximum level of the fine bracket.
Section 5, Article 9 of this Law stipulates that cases where the administrative violator is entitled to a reduced penalty include: the administrative violator is a pregnant woman, elderly, person with illness or disability that limits their cognitive ability or capacity to control their actions.
Currently, traffic penalties will be implemented according to Decree 100/2019/ND-CP, and accordingly, if the violator is a pregnant woman, the penalty may be reduced but still based on the principle that the fine may be reduced but not below the minimum level of the fine bracket.
