Penalty for Operating Motorbikes or Mopeds Without Exhaust Silencers and Smoke Reducers
According to Point 1d, Article 17 of Decree No. 100/2019/ND-CP, this is stipulated as follows:
A fine ranging from VND 100,000 to VND 200,000 shall be imposed for the following violations:
Operating a vehicle without exhaust silencers and smoke reducers, or with those components not meeting environmental standards on emissions and noise.
Is the Driver's License Revoked for Operating Motorbikes or Mopeds Without Exhaust Silencers?
Based on Point 4, Decree No. 100/2019/ND-CP, the regulation is as follows:
- In addition to monetary fines, the driver committing the violation may also face the following supplementary penalties:
a) Committing the acts specified in Point d, Clause 1 of this Article will result in the horn being confiscated;
b) Committing the acts specified in Points b and c, Clause 2 of this Article will result in the confiscation of the vehicle registration certificate and the non-compliant or altered license plate;
c) Committing the acts specified in Point a, Clause 3 of this Article will result in the suspension of the driver's license for 01 month to 03 months;
d) Committing the acts specified in Point b, Clause 3 of this Article will result in the confiscation of the vehicle and the suspension of the driver's license for 01 month to 03 months;
dd) Committing the acts specified in Points a and b, Clause 2 of this Article in case of no vehicle registration certificate, or using a vehicle registration certificate not issued by a competent authority, with incorrect chassis and engine numbers, or erased such that the source of the vehicle (not having proper documents of ownership transfer or legal origin documents) cannot be proven, will result in the confiscation of the vehicle.
Thus, the act of operating a motorbike or moped without exhaust silencers does not result in the revocation of the driver's license under the above regulation.
