Penalties for Forging the Signature of the Notarization Requester

According to the provisions at Point a Clause 3 Article 12 of Decree 82/2020/ND-CP, regarding the act of forging the signature of the person requesting notarization to notarize a fraudulent contract, the penalty can be up to 30 million VND, with the specific penalty as follows:

"3. A fine ranging from 20,000,000 VND to 30,000,000 VND shall be imposed for one of the following acts:

a) Forging, hiring, or asking someone else to forge the person requesting notarization; forging, hiring, or asking someone else to forge the person with rights and obligations related to the contract or transaction to notarize the contract or transaction; forging the signature of the person requesting notarization;"

In addition, according to the provisions at Point a Clause 5 Article 12 of Decree 82/2020/ND-CP, for the aforementioned act, remedial measures must also be applied. To be specific:

"a) Forcing the notarization practice organization that is storing notarization records to notify the agency, organization, or individual with related rights and obligations about the violation mentioned in Clause 2 and Points a, b, and c of Clause 3 of this Article;"

Thus, according to current legal provisions, the act of forging the signature of the person requesting notarization may be fined up to 30,000,000 VND.
