According to Point q, Clause 3, Article 5 of Decree 100/2019/ND-CP:
The driver of an automobile and similar vehicles carrying people without seat belts fastened (at positions equipped with seat belts) while the vehicle is in motion shall be fined from 800,000 VND to 1,000,000 VND.
Additionally, Clause 5, Article 11 of Decree 100/2019/ND-CP also stipulates:
A fine from 300,000 VND to 500,000 VND shall be imposed on passengers in an automobile who do not fasten their seat belts (at positions equipped with seat belts) while the vehicle is in motion.
Therefore, for the act of passengers in an automobile not fastening their seat belts, both the passenger and the driver will be penalized.
