Operating a car with a breath alcohol concentration exceeding 0.25 - 0.4 milligrams per liter of breath: What are the penalties?
At Point b, Section 8, Article 5 of Decree 100/2019/ND-CP, it is stipulated:
Article 5. Penalties for drivers of cars and similar vehicles violating the road traffic rules
Fines ranging from VND 16,000,000 to VND 18,000,000 for drivers committing any of the following violations, including:
Driving on the road with a blood alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath.
In addition, the above violation will result in the driver's license being revoked for 16 months to 18 months;
According to the regulations at Point a, Section 1, Article 82 of the Decree, the authorized person to impose penalties is permitted to temporarily seize the vehicle for up to 07 days before making a penalty decision.
=> Hence, the act of driving a car with a breath alcohol concentration exceeding 0.25 - 0.4 milligrams/1 liter of breath will be fined from VND 16,000,000 to VND 18,000,000, the driver's license will be revoked for 16 months to 18 months, and the car will be temporarily seized for up to 07 days before making a penalty decision.
