Operating a bicycle in a dangerous manner, swerving, and weaving: Is it subject to a fine? How much is the fine for swerving and weaving on a bicycle?
When I was returning home from work, I noticed many middle school students swerving and weaving on their bicycles after school, which is very dangerous. I want to know if this behavior is subject to a fine, and if so, how much is the fine?Is zigzagging or swerving while riding a bicycle subject to a fine?
Based on Article 8 of the Road Traffic Law 2008, the following acts are strictly prohibited:
Destroying roads, bridges, tunnels, ferry terminals, traffic lights, signposts, boundary markers, convex mirrors, dividers, drainage systems, and other facilities and equipment pertaining to road traffic infrastructure.
Illicit digging, drilling, or cutting of roads; placing or leaving obstacles on roads; scattering sharp objects or spilling substances causing slipperiness on roads; unauthorized placement of materials, waste, or garbage on roads; unauthorized opening or connecting of roads to main roads; encroaching or illicitly using road land or road safety corridors; unauthorized removal of manhole covers, dismantling, illicit relocation, or altering road facilities.
Unauthorized use of road beds, shoulders, or sidewalks.
Operating motor vehicles and specialized motorcycles that fail to meet technical safety and environmental protection standards on roads.
Altering the structure, components, or accessories of motor vehicles to temporarily meet vehicle inspection standards.
6. Unauthorized racing, promoting racing, organizing illegal races, zigzagging, swerving
Thus, according to current regulations, the act of zigzagging or swerving while riding a bicycle is also prohibited and may be subject to administrative penalties.
How much is the fine for zigzagging or swerving while riding a bicycle?
Based on Clause 3, Article 8 of Decree 100/2019/ND-CP as amended by Point k, Clause 34 Article 2 of Decree 123/2021/ND-CP, the penalties for cyclists, motorized bicycle riders (including electric bicycles), and operators of other rudimentary vehicles who violate road traffic rules are as follows:
- A fine of VND 300,000 to VND 400,000 will be imposed on operators for any of the following violations:
a) Operating the vehicle in a zigzagging or swerving manner; chasing each other on the road;
b) Riding a bicycle or motorized bicycle on one wheel; riding a tricycle on two wheels;
c) Entering prohibited areas; roads with signs indicating prohibition for the type of vehicle being operated; driving against the direction on one-way streets or roads with “No Entry” signs;
Clause 5 of this Article also stipulates:
- In addition to the fine, operators who repeatedly commit, or commit multiple times, the violations specified in points a and b of Clause 3 of this Article, will also be subject to the additional penalty of confiscation of the vehicle.
Thus, according to current regulations, if you operate a bicycle in a zigzagging or swerving manner, you will be subject to a fine ranging from VND 300,000 to VND 400,000. Additionally, the operator may be subject to the supplementary penalty of vehicle confiscation if the violations are repeated.
