Late Penalty after 30 Days from the Date of Receiving the Fine Decision: How Much Will Be Paid?
How much is the fine for paying 30 days late from the date of receiving the penalty decision?
According to Clause 1, Article 78 of the Law on Handling Administrative Violations 2012 and Clause 39, Article 1 of the Amended Law on Handling Administrative Violations 2020, the regulations are as follows:
Article 78. Procedures for Paying Fines
- Within the enforcement period of the penalty decision as prescribed in Clause 2, Article 68, or Clause 2, Article 79 of this Law, the penalized individuals or organizations must pay the fines at the State Treasury or to the account of the State Treasury as recorded in the penalty decision, except for cases where the fines are paid as prescribed in Clause 2 of this Article. If the aforementioned period is exceeded, the penalty decision will be enforced compulsorily, and for each day of delayed payment, the violating individuals or organizations must pay an additional 0.05% based on the total amount of unpaid fines.
Clause 2, Article 68 of the Law on Handling Administrative Violations
Article 68. Content of the Administrative Penalty Decision
- The enforcement period of the decision is 10 days from the date of receiving the penalty decision; in case the penalty decision specifies a period longer than 10 days, the implementation follows that specified period.
In your case, as you mentioned a late payment of 30 days from the date of receiving the penalty decision, you will be charged 20 days of late payment. The amount you need to pay for being 30 days late from the penalty decision date is calculated as follows:
Fine Amount + [(Fine Amount * Percentage Rate on Late Payment Amount) * Number of Days Late]
₫800,000 + [(₫800,000 * 0.05%) * 20] = ₫808,000
Thus, the amount you need to pay is ₫808,000.
How is the fine payment in remote areas handled?
According to Clause 2, Article 78 of the Law on Handling Administrative Violations:
Article 78. Procedures for Paying Fines
- In remote, isolated, border, or mountainous areas where travel is difficult, the penalized individuals or organizations can pay the fines to the competent person imposing the penalty. The person authorized to impose penalties is responsible for collecting the fines on-site and depositing them at the State Treasury or into the State Treasury account within no more than 07 days from the date of collecting the fine.
Thus, in remote, isolated, border, or mountainous areas where travel is difficult, penalized individuals or organizations can pay the fines to the competent person imposing the penalty.
Sincerely,
