Is Vehicle Detention for 2 Months Due to Traffic Violations Legal?
According to Clause 8, Article 125 of the 2012 Law on Handling Administrative Violations, the duration of temporary seizure of means of violation is stipulated as follows:
The duration of temporary seizure of evidence, administrative violation means, licenses, and practice certificates is 07 days, from the date of seizure. The detention period may be extended for cases with many complex details, requiring verification, but not exceeding 30 days from the date of seizure of evidence, licenses, and practice certificates.
Thus, seizing vehicles - temporarily holding vehicles due to traffic violations for 2 months is against the law.
You can file a complaint to the head of the agency of that officer for resolution.
