Is there administrative fine imposed on the act of injection of water into domesticated animal body in Vietnam? Is it permissible to leave animals unattended on roads in Vietnam? What are regulations on collection, preservation, use and development of livestock gene sources in Vietnam?
Hello Lawnet. My family has livestock. On November 20, I have to slaughter a pig for my village to worship, but the pig has not reached the required weight to slaughter. I plan to pump water into the pig to increase the weight of it and then slaughter it. Is there any fine for this act?

Is there administrative fine imposed on the act of injection of water into domesticated animal body in Vietnam?
Pursuant to Clause 10 Article 12 of the Law on Animal Husbandry in 2018 stipulating prohibited acts in animal husbandry as follows:
10. Coercive use or insertion of substances or objects or injection of water into domesticated animal body and products thereof for trade fraud purpose.
Pursuant to Clause 4, 5 and 6, Article 29 of the Decree 14/2021/NĐ-CP stipulating offences against regulations on animal husbandry, humane treatment for domesticated animals and control of slaughter of terrestrial animals as follows:
4. Offences arising from introducing foreign bodies, coercively pumping water or other substances into the bodies of terrestrial animals before slaughter shall be sanctioned as follows:
a) Imposing the fine of between 5,000,000 dong and 10,000,000 dong if total weight of animals involved in these offences is less than 100 kg;
b) Imposing the fine of between 10,000,000 dong and 20,000,000 dong if total weight of animals involved in these offences is between 100 kg and under 500 kg;
c) Imposing the fine of between 20,000,000 dong and 30,000,000 dong if total weight of animals involved in these offences is between 500 kg and under 1,000 kg;
d) Imposing the fine of between 30,000,000 dong and 50,000,000 dong if total weight of animals involved in these offences is at least 1,000 kg.
5. Other supplementary penalties:
a) The penalty existing in the form of seizure of exhibits shall be imposed for the offences arising from the act of deteriorating animal production activities as referred to in Clause 3 of this Article;
b) The penalty existing in the form of temporary suspension of business for the duration of between 01 and 06 months shall be imposed for the offences referred to in Clause 4 of this Article.
6. Remedies
Compelling the thermal treatment of animals involved in the offences prescribed in clause 4 of this Article; in case of repeating such offences, the destruction thereof shall be required.
Pursuant to Clause 2 Article 5 of the Decree 14/2021/NĐ-CP stipulating as follows:
2. The amount of fine stipulated in Chapter II shall be deemed as the amount of fine for the administrative offence committed by an individual. If an organization commits the same offence, the amount of imposed on that organization shall be 02 times greater than that imposed on an individual.
Therefore, the act of pumping water into livestock before slaughter is considered a commercial fraud and is an act that is prohibited. If you want to pump water into the pigs that you are preparing to slaughter to reach the required weight, you are violating the law.
The amount of the fine for this act will depend on the total weight of the animals involved, and can be from VND 5,000,000 to VND 50,000,000. In addition, you will be suspended from operations for 1 to 6 months and required to heat-treat the pigs that you have pumped water into.
Is it permissible to leave animals unattended on roads in Vietnam?
Pursuant to Clause 2 Article 35 of the Law on Road Traffic in 2008 stipulating other activities on roads as follows:
2. The following acts are prohibited:
a/ Holding markets, buying and selling goods on roads;
b/ Illegally gathering people on roads;
c/ Leaving animals unattended on roads;
d/ Drying paddy, rice stock and straw, agricultural products and other objects on roads;
e/ Placing advertisement billboards on road land;
f/ Installing boards, advertisement billboards or other equipment distracting road user attention to, and misleading the meanings of, road signs, or obstructing road users;
g/ Concealing road signs and traffic light signals;
h/ Using skateboards or roller-skates or similar equipment on the carriageways;
i/ Other acts obstructing traffic.
As regulations above, leaving animals unattended on roads is an act of obstructing traffic. Therefore, anyone committing this violation shall face adminstrative fines.
What are regulations on collection, preservation, use and development of livestock gene sources in Vietnam?
Pursuant to Article 14 of the Law on Animal Husbandry in 2018 stipulating collection, preservation, use and development of livestock gene sources in Vietnam as follows:
1. Organizations and individuals involved in collection, preservation and development of livestock gene sources must comply with regulations hereof and other relevant law provisions.
2. Collection, preservation, use and development of livestock gene sources shall include the following activities:
a) Investigation, survey and collection of livestock gene sources;
b) Assessment of livestock gene sources based upon bio-criteria and useful value thereof;
c) Establishment of livestock gene source database;
d) Protection and maintenance of livestock gene sources;
dd) Use of livestock gene sources that are assessed and whose useful value is determined in selection, production and multiplication of livestock breeds.
3. Methods for preservation of livestock gene sources shall be applied in compliance with provisions of the law on biodiversity.
4. The Ministry of Agriculture and Rural Development shall take charge and cooperate the Ministry of Natural Resources and Environment, Ministry of Science and Technology, other ministries and relevant ministerial agencies in sending proposal of collection, preservation, use and development of livestock gene sources under agricultural management to the Government.
