Hi, I have a problem that needs to be answered. On October 6, I went to my friend's house to drink. But I was afraid that the police would arrest me for riding a motorbike because I was drunk, so I went by bicycle to my friend's house. But when I returned, I was still arrested by the police and fined 500,000 VND for having 0.5 milligram of concentration of alcohol in my blood. May I ask if riding a bicycle after drinking is still fined by the police? And if there is a fine, how much is the fine?

In Article 8 of the 2008 Road Traffic Law, as amended by Clause 1, Article 35 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer 2019, the prohibited acts are as follows:
1. Destroying roads, road bridges, tunnels and ferry landing stages, light signals, marker posts, signs, dome mirrors, median strips, water drainage systems and other works and equipment of road traffic infrastructure.
2. Illegally digging, drilling and cutting roads; illegally placing or erecting hurdles on roads; placing and spreading pointed objects, pouring lubricants on roads; illegally leaving materials, wastes and garbage on roads; illegally opening passages and linking to main roads; illegally encroaching, occupying or using land of roads and road safety corridors; opening manhole covers without permission, illegally dismantling, removing or falsifying road works.
3. Illegally using roadbeds, roadsides and pavements.
4. Putting motor vehicles and special-use machines which fail to satisfy technical safety and environmental protection criteria into operation on roads.
5. Changing the chassis, components and accessories of motor vehicles in order to temporarily achieve their technical criteria before taking them for inspection.
6. Taking part in, cheering or organizing illegal vehicle races, driving vehicles recklessly on crowded streets or in zigzags.
7. Operating a road motor vehicle while there is narcotic in the operator’s body.
8. 8. Operate vehicles under the influence of alcohol.

How much is police fine for riding a bicycle to home after drinking alcohol in Vietnam?
According to Article 8 of Decree 100/2019/ND-CP as amended by Point k, Clause 34, Article 2 of Decree 123/2021/ND-CP, stipulating penalties imposed upon operators of bicycles, motored bicycles (including electric bicycles), and other non-motorized vehicles violating traffic rules:
3. A fine ranging from VND 300,000 to VND 400,000 shall be imposed upon a vehicle operator who commits any of the following violations:
a) Weaving, speeding and chasing on public roads;
b) Running on one wheel (or two wheel if the vehicle is a tricycle);
c) Entering restricted areas; roads erected with signs prohibiting entry of operated vehicles; going against traffic direction on one-way streets, roads erected with “Cấm đi ngược chiều” (No entry) signs;
d) The operator of motored bicycle (including electric bicycle) not wearing motorcycle helmets properly or wearing helmets improperly;
dd) Carrying a person on a motored bicycle (including electric bicycle) who does not wear the motorcycle helmet or does not wear the helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted;
e) Operating a vehicle while BAC exceeds 50 - 80 mg per 100 ml of blood or BrAC exceeds 0.25 - 0.4 mg per liter of breath;
4. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:
a) Entering a freeway, except for the vehicles serving the management and maintenance of the freeway;
b) Failure to stop, protect the scene, inform the authority, or give first aid to the victim after causing an accident;
c) Operating the vehicle while BAC exceeds 80 mg per 100 ml of blood or BrAC exceeds 0.4 mg per liter of breath;
d) Failure to comply with the law enforcement officer’s order for alcohol content testing.
Therefore, the penalty for riding a bicycle after drinking will depend on the alcohol concentration in the blood or in the breath. If you have 0.5 milligram of alcohol in 1 liter of your breath, the police will fine you 500,000 VND in accordance with the law in Vietnam.
What are prohibited behaviors for riders of bicycles in Vietnam?
According to Article 31 of the 2008 Road Traffic Law, riders of and passengers on bicycles, operators of other rudimentary vehicles are as follows:
1. Bicycle riders may carry only one person or two persons including an under-7 child.
Bicycle riders shall comply with the provisions of Clause 3, Article 30 of this Law; passengers on bicycles traveling on the roads shall comply with the provisions of Clause 4, Article 30 of this Law.
2. Operators of and passengers on motor bicycles shall wear safety helmets, properly fastening their chin straps.
3. Operators of other rudimentary vehicles may not travel two or more abreast, shall travel on the lane reserved for rudimentary vehicles, if such lane is available; when traveling at night, these vehicles must have signals at their front and rear. Operators of animal-drawn carts shall take measures to ensure public sanitation.
4. Goods loaded on rudimentary vehicles must ensure safety, without obstructing traffic and the operator’s view.
Pursuant to Clause 3, Article 30 of the Law on Road Traffic 2008, stipulates that operators of motorcycles, three-wheeled motor vehicles or mopeds are prohibited from:
a/ Traveling abreast;
b/ Traveling in road sections reserved for pedestrians and other vehicles;
c/ Using umbrellas, mobile phones and audible devices, except hearing aids;
d/ Pulling and pushing other vehicles or objects, and carrying bulky objects;
e/ Operating the vehicle without holding the handlebars or on one wheel, for two-wheeled vehicles, or on two wheels, for three-wheeled vehicles;
f/ Other acts badly affecting traffic order and safety.
The above are prohibited behaviors in Vietnam that cyclists should be aware of.
