Is it possible to pay fines on the spot to traffic police?
Based on Clause 5 Article 6 of Decree 100/2019/ND-CP stipulates: A fine ranging from 1,000,000 VND to 2,000,000 VND shall be imposed on drivers who commit acts of driving against the direction of one-way streets, driving against the direction on roads with "No Entry" signs, except for violations specified at Point b, Clause 6 of this Article and cases where priority vehicles are on urgent duties as prescribed.
Additionally, the driver's license will be revoked from 1 month to 3 months.
According to Article 73 of the Law on Handling of Administrative Violations 2012, the implementation of administrative penalty decisions is regulated as follows:
- Individuals and organizations subject to administrative penalties must comply with the penalty decision within 10 days from the date of receiving the administrative penalty decision; in cases where the administrative penalty decision specifies a longer execution period than 10 days, it shall comply with that period.
In cases where individuals or organizations subject to penalties lodge complaints or initiate lawsuits against the administrative penalty decisions, they must still comply with the penalty decisions, except for the cases specified in Clause 3 Article 15 of this Law. Complaints or lawsuits shall be resolved according to legal provisions.
- The person authorized to impose the penalty who has issued the penalty decision is responsible for monitoring and inspecting the compliance with the penalty decision by individuals or organizations subject to the penalty and notifying the completion results of the decision implementation to the administrative violation handling database management agency of the Ministry of Justice, local judicial agencies.
Furthermore, Article 10 of Decree 81/2013/ND-CP stipulates the forms of payment of fines as follows:
- Direct payment at the State Treasury or a commercial bank authorized by the State Treasury to collect fines as specified in the penalty decision;
- Direct payment or bank transfer to the State Treasury account specified in the penalty decision;
- Direct payment to the authorized person imposing the penalty as prescribed in Clause 1 Article 56, Clause 2 Article 78 of the Law on Handling of Administrative Violations or direct payment to the port authority or the representative of the airport authority in cases where the penalized person is a transit passenger through Vietnam's territory for an international flight departing from Vietnam's territory; crew members on duty on the transit flight through Vietnam's territory; crew members of foreign airlines performing international flights departing from Vietnam's territory.
Thus, if you do not belong to remote, border, or mountainous areas where travel is difficult, direct payment of fines to traffic police is against regulations.
However, if you belong to remote, border, or mountainous areas where travel is difficult, direct payment of fines to traffic police is correct when the penalty decision is made by the Head of the Police Department.
