Is it permissible for parents to drive motorbikes and carry 2 children on the same motorbikes in Vietnam? What are the fines imposed on parents for driving motorbikes and carrying 2 children on the same motorbikes in Vietnam? What is the maximum number of people that can be carried on the electric bikes in Vietnam?

Hello Lawnet. My wife and I share a motorbike. Everyday, I carry my wife and our two children to school on that motorbike. Yesterday, my husband and I also took two children to school but we were arrested by the police for carrying more than the allowed number of people. Is that correct? What are the fines imposed on us? Is it permissible for parents to drive motorbikes and carry 2 children on the same motorbikes in Vietnam?

Pursuant to Article 30 of the Law on Road Traffic in 2008 stipulating operators of and passengers on motorcycles and mopeds as follows:

1. The operator of a motorcycle or moped may carry only one person, except for the following cases in which carrying two persons at most is permitted:

a/ Carrying sick persons for emergency medical treatment;

b/ Escorting a person who has committed an illegal act;

c/ Carrying children under 14 years of age.

2. The operators and passengers of motorcycles, three-wheeled motor vehicles or mopeds shall wear safety helmets, properly fastening their chin straps.

3. Operators of motorcycles, three-wheeled motor vehicles or mopeds are prohibited from:

a/ Traveling abreast;

b/ Traveling in road sections reserved for pedestrians and other vehicles;

c/ Using umbrellas, mobile phones and audible devices, except hearing aids;

d/ Pulling and pushing other vehicles or objects, and carrying bulky objects;

e/ Operating the vehicle without holding the handlebars or on one wheel, for two-wheeled vehicles, or on two wheels, for three-wheeled vehicles;

f/ Other acts badly affecting traffic order and safety.

4. Passengers of motorcycles, three-wheeled motor vehicles or mopeds in traffic are prohibited from:

a/ Carrying bulky objects;

b/ Using umbrellas;

c/ Clinging to, pulling or pushing other vehicles;

d/ Standing on the saddle or pillion, or sitting on the handlebars;

e/ Other acts baldy affecting traffic order and safety.

As regulations above, the operator of a motorcycle or moped may carry 2 persons. However, one of them or both of them must be under 14 years old.

Therefore, parents may only carry only one child under 14 years old on the same motorbikes. In case of carrying 2 children, parents shall be fined for carrying more than the allowed number of people.

In case carrying 02 people on the motorbikes:

Pursuant to Clause 2 Article 6 of the Decree 100/2019/NĐ-CP (amended by Article 2 of the Decree 123/2021/NĐ-CP) stipulating penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules as follows:

2. A fine ranging from VND 200,000 to VND 300,000 shall be imposed upon a vehicle operator who commits any of the following violations:

a) Stopping, parking on the roadway outside urban areas where sidewalks are available;

b) Failure to reduce speed and yield when joining the traffic from an alley or when moving from a small road to a major road;

c) Exceeding the speed limits by from 5 km/h to under 10 km/h;

dd) Going slowly without keeping to the right of the roadway in a manner that obstructs the traffic;

dd) Stopping, parking on the roadway in a manner that obstructs the traffic; stopping in groups of 03 vehicles or more on the roadway or in a road tunnel; parking on the roadway or on the sidewalk in urban areas against the law;

e) Failure to allow another vehicle to overtake when it is safe to do so; failure to yield to vehicles in the emergency lane or on the major road at the intersection;

g) Using warning devices for emergency vehicles on a non-emergency vehicle;

h) Stopping, parking on the tramway, at the bus stop, at an intersection, at a crosswalk; stopping where a “Cấm dừng xe và đỗ xe” (No stopping and parking) sign is erected, parking where a “Cấm đỗ xe” (No parking) sign or “Cấm dừng xe và đỗ xe” (No stopping and parking) sign is erected; breaking the rules on stopping and parking at intersection with the railway; stopping or parking within the railway safety perimeter, except for the violations specified in Point b Clause 2, Point b Clause 3 Article 49 of this Decree;

l) Carrying two people on a vehicle, unless a person being carried is a person who needs urgent medical care, a child under 14 years of age, or a criminal being escorted;

m) The vehicle is operated by the person from behind another person, unless such the latter is a child.

In case carrying 03 people on the motorbikes:

Pursuant to Clause 3 Article 6 of the Decree 100/2019/NĐ-CP (amended by Clause 4 Article 2 of the Decree 123/2021/NĐ-CP) stipulating penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules as follows:

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:

a) Turning without slowing down or signaling (except for going along a curved segment where there is no intersection); making a left turn while operating a vehicle prohibited from doing so by a “no left turn” sign; making a right turn while operating a vehicle prohibited from doing so by a “no right turn” sign;

b) Carrying 03 people or more on the vehicle;

c) Continuously honking, revving the engine in urban areas or residential areas, except for the emergency vehicles on duty;

d) Stopping or parking on a bridge;

dd) Going in groups in a manner that obstructs the traffic, except for the cases permitted by competent authorities;

e) Operating a vehicle that involves in an accident without stopping the vehicle, protecting the crash scene, or giving first aid to the victims, except for the violations specified in Point dd Clause 8 of this Article;

g) Failure to keep the vehicle to the right; going in the wrong lane; crossing the median strip; going on a sidewalk unless for entering a house;

h) Overtaking on the right side where prohibited;

i) Entering prohibited areas, roads erected with signs prohibiting entry of operated vehicles, except for violations specified in Clause 5, Point b Clause 6 of this Article and emergency vehicles on missions;

k) The operator’s or passenger’s pulling or pushing another vehicle or item while sitting on the vehicle; leading an animal or carrying a bulky object while sitting on the vehicle; standing on the seat, the cargo bracket, or sitting on the handle; loading cargo to the vehicle beyond permissible limits; towing another vehicle or object;

l) Exceeding the gross vehicle weight rating (GVWR) written on the Certificate of vehicle registration (if the GVWR is stated);

m) Failure to turn on low beam while operating the vehicle in a road tunnel;

n) Failure to wear a motorcycle helmet properly or wearing it improperly;

o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.

As regulations above, if parents carry 02 children, they will be from VND 400,000 to VND 600,000 for carrying 03 people on a motorbike (04 people including driver, and 03 passengers).

What is the maximum number of people that can be carried on the electric bikes in Vietnam?

Pursuant to Article 31 of the Law on Road Traffic in 2008 stipulating riders of and passengers on bicycles, operators of other rudimentary vehicles as follows:

1. Bicycle riders may carry only one person or two persons including an under-7 child.

Bicycle riders shall comply with the provisions of Clause 3, Article 30 of this Law; passengers on bicycles traveling on the roads shall comply with the provisions of Clause 4, Article 30 of this Law.

2. Operators of and passengers on motor bicycles shall wear safety helmets, properly fastening their chin straps.

3. Operators of other rudimentary vehicles may not travel two or more abreast, shall travel on the lane reserved for rudimentary vehicles, if such lane is available; when traveling at night, these vehicles must have signals at their front and rear. Operators of animal-drawn carts shall take measures to ensure public sanitation.

4. Goods loaded on rudimentary vehicles must ensure safety, without obstructing traffic and the operator’s view.

As regulations above, riders of electric bikes may only carry 1 person. They can carry another person if the two passengers include a 7-year-old child.
