Pursuant to Article 31 of the Law on Road Traffic in 2008 stipulating riders of and passengers on bicycles, operators of other rudimentary vehicles as follows:
Riders of and passengers on bicycles, operators of other rudimentary vehicles
1. Bicycle riders may carry only one person or two persons including an under-7 child.
Bicycle riders shall comply with the provisions of Clause 3, Article 30 of this Law; passengers on bicycles traveling on the roads shall comply with the provisions of Clause 4, Article 30 of this Law.
2. Operators of and passengers on motor bicycles shall wear safety helmets, properly fastening their chin straps.
3. Operators of other rudimentary vehicles may not travel two or more abreast, shall travel on the lane reserved for rudimentary vehicles, if such lane is available; when traveling at night, these vehicles must have signals at their front and rear. Operators of animal-drawn carts shall take measures to ensure public sanitation.
4. Goods loaded on rudimentary vehicles must ensure safety, without obstructing traffic and the operator’s view.
As regulations above, operators of and passengers on motor bicycles shall wear safety helmets, properly fastening their chin straps.
Electric bicycles are classified as mopeds, so the driver and passenger of an electric bicycle must wear a helmet when participating in traffic.

When is it not necessary to wear a helmet when riding a motorbike in Vietnam?
Pursuant to Clause 3 Article 6 of the Decree 100/2019/NĐ-CP (amended by Clause 4.a and 4.b, Article 2 of the Decree 123/2021/NĐ-CP) stipulating violation of not wearing helmet as follows:
Penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:
...
n) Failure to wear a motorcycle helmet properly or wearing it improperly;
o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted.
As regulations above, there are 3 cases in which people does not have to wear helmet:
- Case 1: a patient who needs urgent medical care
- Case 2: a child under 06 years of age
- Case 3: a criminal being escorted
