Is it necessary to have permit to transport explosive pyrotechnic composition in Vietnam?

Pursuant to Clause 2 Article 13 of the Decree 137/2020/NĐ-CP, transportation of fireworks and explosive pyrotechnic composition must satisfy following requirements:

- Transport permit or transport order of competent agencies is required; and

- Individuals and specialized vehicles for transporting fireworks and explosive pyrotechnic composition must meet industrial explosive transportation requirements as per the law; and

- Specialized vehicles satisfying fireworks, explosive pyrotechnic composition transportation, fire prevention and environmental protection requirements must be employed; and

- fireworks, explosive pyrotechnic composition, fireworks accessories and personnel (other than those responsible for transportation) must not be transported by the same vehicles;

- Vehicles transporting fireworks and explosive pyrotechnic composition must not park or stop in crowded areas, residential areas, close to gas filling stations, in the vicinity of important structures in terms of national defense, security, economy, culture and foreign affairs. In case of night rest or accidents, immediately inform the nearest military authorities or police authorities for cooperation and protection if necessary and adopt protective and fire prevention measures.

As regulations above, it is compulsory to have license or order of competent agencies to transport explosive pyrotechnic composition in Vietnam.

What are the fines for transporting explosive pyrotechnic composition without permit in Vietnam?

Pursuant to Clause 4 Article 11 of the Decree 144/2021/NĐ-CP, a fine ranging from 10.000.000 VND to 20.000.000 VND shall be imposed for any of the following violations:

- Illegally manufacturing, providing, storing, transporting, repairing cold weapons or combat gears; parts or assemblies of weapons or combat gears, or explosive components;

- Appropriating cold weapons or combat gears; parts or assemblies of weapons or combat gears, or explosive components;

- Illegally manufacturing, storing, transporting, using weapons that have similar functions to hunting guns, cold weapons, sporting weapons or parts, assemblies for manufacture of weapons or combat gears with similar functions;

- Manufacturing, providing, storing, transporting, repairing, using appropriating hunting guns, parts or assemblies thereof;

- Illegally excavating, searching, collecting weapons, explosive materials, combat gears, wastes or scraps thereof;

- Illegally transporting, storing firecrackers, fireworks, pyrotechnic compositions, materials or components for production thereof;

- Losing military or sporting weapons;

- Illegally sawing, cutting or otherwise defusing bombs, mines, bullets, grenades, explosives, naval mines, torpedoes and other weapons;

- Illegally instructing, training, organizing training in fabrication, production, repair or use of weapons and combat gears in any shape or form.

As regulations above, a fine ranging from 10.000.000 VND to 20.000.000 VND shall be imposed for transporting explosive pyrotechnic composition without permit in Vietnam. the illegal profits earned from commission of the administrative violations shall be returned.
