Is It Mandatory to Have Local Permanent Residence to Open a Pawn Shop?
According to Clause 4, Article 3 of Decree 96/2020/ND-CP, pawn service business is a conditional business investment sector concerning security and order.
Article 9 of Decree 96/2020/ND-CP stipulates the conditions regarding security and order for pawn service businesses as follows:
In addition to the conditions specified in Article 7 of this Decree, the pawn service business establishment must meet the following conditions:
The person responsible for the security and order of the pawn service business establishment must have had permanent residence registration for at least 5 years in the commune, ward, commune-level town where the business location is registered and within the 5 consecutive years preceding the business registration date, must not have been administratively sanctioned by the competent authority for violations such as: Resisting law enforcement officers, disturbing public order, intentionally causing injury, high-interest lending, gambling, organizing gambling or gambling dens, theft of property, fraud, misappropriation of property, or unlawful possession of property.
According to this regulation, the person responsible for the security and order of the pawn shop must have had permanent residence registration for at least 5 years in the commune, ward, commune-level town where the business location of the shop is registered.
Furthermore, Clause 5, Article 4 of Decree 96/2020/ND-CP explains: The person responsible for the security and order of a business establishment is:
- The legal representative, the manager of the business establishment, the owner of the business establishment whose name is stated in the documents specified in Clause 2, Article 19 of this Decree;- The person authorized by the individuals specified in point a of this Clause to sign the Certificate of eligibility for security and order.
Thus, even if you do not have permanent residence in District 7, you can still open a pawn shop in District 7 if you authorize another person to sign the Certificate of eligibility for security and order.
This person must have had permanent residence registration for at least 5 years in Ward 6, District 7. Concurrently, within the 5 consecutive years preceding the business registration date, this person must not have been administratively sanctioned for the specified violations.
