Is it Correct for the Traffic Police to Refuse to Show Violation Images when Requested?
Point a, Clause 3, Article 19 of Circular 65/2020/TT-BCA stipulates the control through means and technical equipment as follows:
When controlling through a monitoring system, speed measurement devices with image recording, image recording devices, detection, recording images of people and vehicles participating in road traffic offenses, the head of the Traffic Police unit has the authority to implement as follows:
Organize forces to stop traffic vehicles to control and handle violations according to legal regulations. In case the violator requests to see the images and recorded results of the violation, allow them to view if the images and results are available there; if not available, guide the violator to view the images and recorded results when arriving at the unit’s headquarters for violation processing.
According to the above regulation, when the violator requests to see the images and recorded results of the violation:
- If the images and recorded results are available there, the Traffic Police allow viewing;
- If not available, guide the violator to view the images and recorded results when arriving at the unit’s headquarters for violation processing.
=> Therefore, when you request to see the violation images recorded from the speed measurement device, the Traffic Police must handle according to the above regulation. If the Traffic Police refuse to let you see the violation images upon request, it does not comply with legal regulations.
