Is it compulsory to yield to ambulanes when stopping at red lights in Vietnam? What are the penalties for not yielding to emergency vehicles in Vietnam?
Hello Lawnet. I'm in 8th grade. On June 14th , me and my dad were stopping at red lights at Phan Xich Long and Phan Dang Luu crossroads. Suddenly, there was on-duty an ambulance coming from behind. Then, everyone moved to the sides of the road to yield to that ambulance. Is it compulsory to yield to ambulanes when stopping at red lights in Vietnam? Thanks for your advice.

Pursuant to Article 22 of the Law on Road Traffic in 2008 stipulating priority rights of a number of vehicles in Vietnam as follows:
1. The following vehicles have the priority right to go before other vehicles when passing intersections from any direction of traffic in the following order:
a/ Fire engines traveling on duty;
b/ Military vehicles and police vehicles on urgent duty; motorcades led by police cars;
c/ Ambulances on duty;
d/ Dike-watch vehicles, vehicles employed in overcoming natural disasters or epidemics or in a state of emergency as prescribed by law;
e/ Funeral vehicle processions.
2. Vehicles specified at Points a, b, c and d of Clause 1, this Article, when traveling on duty, shall give signals by means of horn, banner and light according to regulations; are not restricted in speed; may enter one-way roads from the opposite direction and other roads open to traffic, even go through the red light, and must only follow the instructions of persons directing traffic.
The Government shall issue specific regulations on signals of priority vehicles.
3. When recognizing the signals of priority vehicles, road users shall promptly slow down, give way or pull in to the right edge of the carriageway to give way. They may not obstruct priority vehicles.
As regulations above, you shall move to the sides of the road to give way to on-duty ambulances even when stopping at red light.
What are the penalties for not yielding to emergency vehicles in Vietnam?
Pursuant to Clause 3 and 11, Article 5 of the Decree 100/2019/NĐ-CP stipulating penalties imposed upon operators of cars and car-like vehicles violating traffic rules in Vietnam as follows:
3. A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed upon a vehicle operator who commits any of the following violations:

n) Failure to yield to vehicles in the emergency lane or on the major road at an intersection;

11. Apart from incurring fines, the violating operator shall also incur the following additional penalties:
...
c) The violation(s) specified in Point c Clause 5; Points a and b Clause 6; Clause 7 of this Article shall lead to suspension of driving license from 2 months to 4 months. Committing violation(s) specified in Points a, d, dd, e and g of Clause 1; Points b, d and g of Clause 2; Points b, g, h, m, n, r and s of Clause 3; Points a, c, e, g and h of Clause 4; Points a, b, e, g and h Clause 5 of this Article and causing accidents shall lead to suspension of driving license from 2 months to 4 months;

Pursuant to Clause 2 and 10, Article 6 of the Decree 100/2019/NĐ-CP stipulating penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules in Vietnam as follows:
2. A fine ranging from VND 200,000 to VND 300,000 shall be imposed upon a vehicle operator who commits any of the following violations:

e) Failure to allow another vehicle to overtake when it is safe to do so; failure to yield to vehicles in the emergency lane or on the major road at the intersection;

10. Apart from incurring fines, the violating operator shall also incur the following additional penalties:
...
c) The violation(s) specified in Point a Clause 6; Points a and b Clause 7; Points a, b, c and d Clause 8 of this Article shall lead to suspension of driving license from 2 months to 4 months; repetition or multiple violations of offence(s) specified in Points a, b, c and d Claus 8 of this Article shall lead to suspension of driving license from 3 months to 5 months and confiscation of vehicle. Committing violation(s) specified in Points a, g, h, k, l, m and q of Clause 1; Points b, d, e, g, l and m of Clause 2; Points b, c, k and m of Clause 3; Points dd, e, g and h of Clause 4 of this Article and causing accidents shall lead to suspension of driving license from 2 months to 4 months;
As regulations above, the penalties for not yielding to emergency vehicles in Vietnam are as follows:
- An administrative sanction from VND 800,000 to VND 1,000,000 shall be imposed to operators cars and car-like vehicle. If causing accidents, their driving licenses shall be suspended from 2 months to 4 months.
- An administrative sanction from VND 200,000 to VND 300,000 shall be imposed to operators operators of mopeds and motorcycles. If causing accidents, their driving licenses shall be suspended from 2 months to 4 months.
