Is Issuing a Record for Not Carrying Vehicle Registration Papers Without Vehicle Registration Papers Legal?
Based on Clause 3 Article 82 of Decree 100/2019/ND-CP, it is stipulated as follows:
For cases where at the time of inspection, the vehicle operator fails to present one, some, or all of the required documents (Driver's License, Vehicle Registration Certificate, Technical Safety and Environmental Protection Inspection Certificate), the following procedures shall apply:
- The authorized individual shall record an administrative violation report against the vehicle operator for the act of not possessing documents (corresponding to the types of documents not presented), concurrently recording an administrative violation report against the vehicle owner for corresponding violations stipulated in Article 30 of this Decree, and temporarily seize the vehicle as prescribed;
- Within the appointment period for resolving the violation case noted in the administrative violation report, if the violator presents the prescribed documents, the authorized individual shall issue a decision to sanction the act of not carrying the documents for the vehicle operator (no penalty for the vehicle owner);
- After the appointment period for resolving the violation case noted in the administrative violation report, if the violator presents or does not present the prescribed documents, the violator must comply with the administrative violation penalty decision according to the recorded violations noted in the administrative violation report.
Thus, according to the regulation, at the time of inspection, if the vehicle operator fails to present the Vehicle Registration Certificate, the authorized individual shall record an administrative violation report against the vehicle operator for the act of not possessing documents (corresponding to the types of documents not presented). Therefore, when the Traffic Police inspect the documents and the vehicle operator fails to present the Vehicle Registration Certificate, an administrative violation report will be issued for the act of not having the Vehicle Registration Certificate, and subsequently, depending on the specific case, the handling will follow the above-stated regulations.
