In which road traffic routes do district traffic polices handle violations in Vietnam?

Pursuant to Article 6 of Circular 65/2020/TT-BCA regulating patrol and control routes and areas of the Police of provinces and centrally run cities as follows:

2. District-level police arrange forces, organize patrols, control, and handle violations on road traffic routes within administrative boundaries, including:

a) National highways and national highway sections that do not fall into the cases specified in Point b, Clause 1 of this Article;

b) National highway sections belonging to national highway routes specified in Point b, Clause 1 of this Article pass through towns, provincial cities, and district towns according to the plans of the Director of Provincial Police, Head of the Police Department;

c) Provincial roads; district road; Commune roads; specialized roads; Urban roads do not fall into the cases specified in Point c, Clause 1 of this Article;

d) Coordination with the Traffic Police Department to patrol, control and handle violations on road traffic routes within the administrative boundaries according to the plan of the Director of Provincial Police, Head of the Police Department.

3. Pursuant to the provisions in Clauses 1 and 2 of this Article, the Appendix issued with this Circular and the actual situation of local road traffic routes, the Director of Provincial Police shall issue a decision to classify work, arrange forces of the Traffic Police Department and District Police to patrol, control and handle violations on assigned and decentralized routes and areas according to regulations. The decision is sent to the Ministry of Public Security (through the Police Department) for monitoring and direction.

According to the above regulations in Vietnam, district-level police will patrol, control, and handle violations on assigned and decentralized lines and areas according to regulations on force assignment and arrangement decisions issued based on the actual situation without having to carry out inspection according to the subjective will of the district police.

What is authority of head of police department of the district to issue patrol and control plans in Vietnam?

Pursuant to Clause 2, Article 13 of Circular 65/2020/TT-BCA regulating authority to issue patrol and control plans of Provincial Police as follows:

1. Director of Provincial Police:

a) Direct the local Traffic Police force to patrol, control and handle violations within the scope of management;

b) Direct and coordinate with patrol and control forces of the Traffic Police Department when required;

c) Issue plans to patrol, control and handle violations according to the provisions of Point b, Clause 1, Article 12 of this Circular within the scope of management.

3. District Head of police department:

a) Develop a plan to organize the implementation of the plans specified in Point c, Clause 1 of this Article;

b) Develop plans to organize patrols, control, and handle regular or unexpected violations on assigned routes and areas;

At Point b, Clause 1, Article 12 of Circular 65/2020/TT-BCA stipulates as follows:

b) Advise the Minister of Public Security to promulgate plans or directly promulgate implementation plans nationwide as follows:

General plan for road traffic control;

Plan for patrolling, controlling, and handling violations;

Plan for patrolling, controlling, and handling violations by topic;

Plan for patrolling, controlling and handling violations on expressways;

Plan to coordinate with relevant units and agencies to ensure order, traffic safety, security, order and social safety.

According to this Article, head of police department of the district develops a plan to organize patrol, control, and handle violations or irregularities on assigned routes and areas according to the above regulations in Vietnam.
