I'm participating in traffic on the road by motorbike, I'm riding in the right lane and wearing a helmet with straps, my car has a full rearview mirror but the Traffic Police still signaled me to stop the motorbike to check documents. After checking the documents, I did not commit a traffic violation and could continue to drive the car in traffic. I know that there is a Circular that clearly stipulates the tasks, powers, forms, and contents of patrolling and controlling road traffic of traffic police, but I do not clearly understand it. So, let me ask, in what cases are traffic police allowed to stop vehicles to check the documents of people participating in traffic? What is settlement for using fake license plates to participate in traffic?

In what cases are traffic police allowed to stop vehicles participating in traffic to check documents in Vietnam?

Pursuant to Clause 1, Article 16 of Circular 65/2020/TT-BCA regulating stopping vehicles for control in the following cases:

1. Traffic police performing patrol and control tasks according to plan may stop vehicles for control in the following cases:

a) Directly detect or through means and professional technical equipment detect and record violations of road traffic laws and other violations of law;

b) Implement orders, plans for general control of road vehicles, plans for patrolling, controlling, and handling violations according to topics approved by competent authorities;

c) There is a written request from the Head or Deputy Head of the investigation agency; Written request from relevant authorities to stop traffic vehicles for control to ensure security and order, fight against crime and other violations of the law. The written request must specify the time, route, means of transport stopped for control and handling, and the forces involved in coordination;

d) Information, feedback, recommendations, and denunciations from organizations and individuals about violations of the law by people and vehicles participating in road traffic.

According to the above regulations in Vietnam, if you fall into one of these cases, the traffic police have the right to check your documents. You need to seriously comply because this is just a form of checking whether your vehicle documents are complete or not.

What is settlement for using fake license plates to participate in traffic in Vietnam?

In Clause 6, Article 16 of Decree 100/2019/ND-CP amended by Clause 9, Article 2 of Decree 123/2021/ND-CP on penalties imposed upon by operators of motor vehicles (including trailers or semi-trailers being towed) and the like violating regulations on roadworthiness of vehicles:

6. A fine ranging from VND 4,000,000 to VND 6,000,000 shall be imposed for any of the following offences:

a) Operating a vehicle with a license plate other than that specified in the certificate of vehicle registration or with a license plate that is not issued by a competent authority (including trailer and semi-trailer);

b) Using a certificate of technical and environmental safety inspection or stamp of technical and environmental safety or certificate of vehicle registration that is not issued by a competent authority or is falsified; using a certificate of vehicle registration on which the vehicle’s chassis or engine number is incorrect (including trailer and semi-trailer);

c) Operating a vehicle without a certificate of technical and environmental safety inspection or technical and environmental safety inspection stamp (if required, except for temporarily registered vehicles) or with one that has expired for 01 month or more (including trailer and semi-trailer);

d) Operating a vehicle without an adequate quantity of license plates or with an improperly positioned license plate; with a license plate on which the letters and numbers are not distinct; altering the letters or numbers on the license plates by paint or sticker or changing color of the letters, numbers and background of the license plates (including trailer and semi-trailer).

According to Clause 8, Article 16 of Decree 100/2019/ND-CP amended by Clause 9, Article 2 of Decree 123/2021/ND-CP on penalties imposed upon by operators of motor vehicles (including trailers or semi-trailers being towed) and the like violating regulations on roadworthiness of vehicles, specifically as follows:

8. Apart from incurring fines, the violating operator shall incur the following additional penalties:

a) The offence(s) specified in point a, point b clause 3; clause 4; clause 5; point c clause 6; point a clause 7 of this Article shall lead to suspension of the driver’s license from 01 - 03 months;

b) The offence(s) specified in point a, point b clause 3; clause 4 of this Article shall lead to confiscation of additional lights and horns exceeding loudness limit;

c) The offence(s) specified in point a, point b clause 6 of this Article shall lead to confiscation of the certificate of technical and environmental safety inspection or technical and environmental safety inspection stamp, the certificate of vehicle registration or the license plate that is not conformable with regulations or is falsified; suspension of the driver’s license from 01 - 03 months;

d) The offence(s) specified in point b, point c clause 7 of this Article shall lead to confiscation of the vehicle (except for cases in which automobiles with 10 seats or more providing passenger transportation services whose service life exceeds regulations on business conditions of registered business form less than 20 years from the year of manufacture and automobiles with less than 10 seats providing passenger transportation services) and suspension of the driver’s license from 01 - 03 months;

dd) The offence(s) specified in point a clause 4, point b clause 6 of this Article in case of failure to have the certificate of vehicle registration or using the certificate of vehicle registration that is not issued by a competent authority, on which the vehicle’s chassis or engine number is incorrect or which is falsified (including trailer and semi-trailer) without any document proving the vehicle’s origin (no document concerning the transfer of vehicle ownership or document concerning the vehicle’s legal origin) shall lead to confiscation of the vehicle;

Thus, in case of driving a car with a license plate that does not match the vehicle registration certificate or a license plate not issued by a competent authority to participate in traffic, you will be fined from 4,000,000 VND to 6,000,000 VND; having license plates confiscated that do not comply with regulations in Vietnam; The right to use a driver's license will be revoked from 01 month to 03 months.
