Illegal Transportation of Tobacco Valued Under 10 Million Across the Border: What is the Penalty?

According to Clause 1, Article 12 of Decree 96/2020/ND-CP (effective from October 10, 2020), it is stipulated as follows:

"Article 12. Acts of illegal transportation of goods and currency across the border outside the checkpoint areas but not to the extent of criminal prosecution

1. A fine of from VND 1,000,000 to VND 5,000,000 shall be imposed for violations where the value of the infringing goods is less than VND 10,000,000.

….”

According to this regulation, anyone who illegally transports cigarettes with a value of less than VND 10,000,000 across the border outside the checkpoint areas but not to the extent of criminal prosecution shall be fined from VND 1,000,000 to VND 5,000,000 depending on the severity of the violation. Therefore, anyone who illegally transports cigarettes in the aforementioned case will be fined at least VND 1,000,000.
