How Much is the Penalty for Not Transferring Ownership of a Second-Hand Motorcycle?

I purchased a second-hand motorbike from a friend for 20 million VND. If I do not transfer the vehicle ownership, will I be fined? If yes, what is the amount of the fine?

According to Clause 3, Article 6 of Circular 58/2020/TT-BCA, there are regulations concerning the responsibilities of vehicle owners, specifically:

Within 7 days, from the date of making documents for the transfer of vehicle ownership to an organization or individual:

- Transferring ownership to an organization or individual in another province or centrally governed city (hereinafter referred to as transferring to another province): The vehicle owner must directly or authorize an individual, service organization to submit the vehicle registration certificate and number plate to the vehicle registration authority;

- Transferring ownership to an organization or individual within the same province or centrally governed city (hereinafter referred to as transferring within the same province): The vehicle owner must directly or authorize an individual, service organization to submit the vehicle registration certificate to the vehicle registration authority. In cases where an organization or individual purchases, is allocated, given, transferred, or inherits the vehicle and processes the name change procedures immediately, they are not required to retrieve the vehicle registration certificate.

Thus, within 7 days from the date of making the documents for the transfer of vehicle ownership, you must complete the procedures for changing the vehicle's name. Should you fail to comply with the above provisions, you may be fined, specifically:

At Point a, Clause 4, Article 30 of Decree 100/2019/ND-CP, it is stipulated to impose a fine of 400,000 VND to 600,000 VND for individuals, and 800,000 VND to 1,200,000 VND for organizations that are owners of motorcycles, mopeds and similar vehicles for any of the following violations:

Failure to complete the vehicle registration name change procedures (to change the owner's name in the Vehicle Registration Certificate to your own) as stipulated when purchasing, given, donated, allocated, transferred, or inherited a motorcycle, moped, or similar vehicle.

Therefore, you may be fined from 400,000 VND to 600,000 VND for the above violation.
