How much is the fine for picking flowers or breaking tree branches in the park?
Pursuant to the regulations in Section V of Circular 20/2005/TT-BXD, the following acts are prohibited with regards to urban greenery:
- Planting trees listed in the prohibited planting list; planting trees in the restricted planting list without the permission of the competent authority.
- Acts that harm urban trees such as:
+ Unauthorized cutting, transferring, relocating, picking flowers, breaking branches, cutting roots, topping, girdling, lighting fires, placing stoves, dumping trash, hazardous substances, or construction materials at the base of the tree.
+ Unauthorized construction of platforms around the base of the tree, hanging ropes or decorative lights, driving nails, or illegally hanging advertising signs.
- Organizations or individuals responsible for management or assigned to manage fail to comply with the regulations on maintaining, caring for, and developing urban greenery.
Urban greenery includes trees planted along streets and in public areas such as parks, zoos, gardens, promenades, lawns at medians, monuments, and squares.
=> Therefore, the act of picking flowers, breaking tree branches in parks is prohibited. Consequently, any individual who engages in this prohibited act will be subject to legal action.
Clause 1, Article 53 of Decree 139/2017/ND-CP stipulates the penalties for violations related to the protection of green trees, parks, and flower gardens as follows:
- A warning or a fine ranging from 500,000 VND to 1,000,000 VND for acts such as carving, driving nails into trees, unauthorized picking of flowers, cutting branches, peeling bark, defecating, or other acts damaging trees, flower gardens, and lawns.
=> Therefore, the act of picking flowers, breaking tree branches in parks will be subject to a warning or a fine ranging from 500,000 VND to 1,000,000 VND.
