How much is fine for persons sitting in the front seat of a car without fastening the seat belts in Vietnam?

According to Article 9 of the 2008 Road Traffic Law on general rules when participating in road traffic, it is stipulated:

1. Road users shall keep to the right in their travel direction, move on the prescribed lane or road section and obey the road signal system.

2. The driver and persons sitting on the front seats of a car equipped with safety belts shall wear the safety belts.

According to Clause 5, Article 11 of Decree 100/2019/ND-CP regulating penalties for other violations of road traffic rules as follows:

5. A fine ranging from VND 300,000 to VND 500,000 shall be imposed on persons on motorcycles who fail to fasten the seat belts (if available) while the vehicle is running.

According to Point q, Clause 3, Article 5 of Decree 100/2019/ND-CP regulating penalties imposed upon operators of cars and car-like vehicles violating traffic rules as follows:

3. A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed upon a vehicle operator who commits any of the following violations:

q) Carrying passengers who fail to fasten the seat belts (if available) while the vehicle is running;

According to the above regulations in Vietnam, the person sitting in the front seat who does not wear a seat belt will be fined from 300,000 VND to 500,000 VND for the person not driving the vehicle. The vehicle driver will be fined from 800,000 VND to 1,000,000 VND. In this case, the person sitting next to your husband will be fined and your husband will not be fined.

Will persons sitting in back of a car not fastening the seat belts be fined in Vietnam?

According to Article 9 of the 2008 Road Traffic Law on general rules when participating in road traffic, it is stipulated:

2. The driver and persons sitting on the front seats of a car equipped with safety belts shall wear the safety belts.

Thus, the law only stipulates that the driver and the person sitting in the front row of a car must wear a seat belt, but does not require that the person sitting in the back seat must wear a seat belt in Vietnam.

According to this Article, the Traffic Police, within the scope of their assigned functions and tasks, have the authority to sanction acts of transporting people in cars without wearing seat belts in Vietnam.
