In Clause 4, Clause 5 and Clause 6, Article 10 of Decree 144/2021/ND-CP stipulates violations against regulations on issuance, management, use of ID cards and citizen identity cards as follows:

4. A fine ranging from 4.000.000 VND to 6.000.000 VND shall be imposed for any of the following violations:

a) Forging the ID card or citizen identity card or ID number certificate; but not liable to criminal prosecution;

b) Using a forged ID card or citizen identity card or ID number certificate;

c) Pledging the ID card or citizen identity card or ID number certificate, or receiving them as pledge;

d) Buying, selling, taking or granting lease of the ID card or citizen identity card or ID number certificate;

dd) Borrowing, lending the ID card or citizen identity card or ID number certificate for commission of illegal acts.

5. Additional penalty:

Confiscation of the exhibits and means of administrative violations for the violations specified Points b and c Clause 2, Point a Clause 3, points a, b, c and d Clause 4 of this Article.

6. Remedial measures:

a) Mandatory return of the ID card or citizen identity card or ID number certificate in case of violations specified in Point a Clause 2 and Point dd Clause 4 of this Article;

b) Mandatory return of the illegal profits earned from commission of the administrative violations specified in Points a, c, d and dd Clause 4 of this Article.

According to Clause 2, Article 4, Decree 144/2021/ND-CP stipulates the fine level:

2. The fines specified in Chapter II of this Decree are imposed upon administrative violations committed by individuals. The fine imposed upon an organization for the same violation shall be twice the fine imposed upon an individual.

Thus, when forging citizen identification in Vietnam, Mr. M next to your house will be fined from 4,000,000 VND to 6,000,000 VND. In addition, that citizen identification card will be confiscated and forced to pay back the illegal profits from forging citizen identification cards.

Is there criminal liability for forging citizen identity cards in Vietnam? 

Pursuant to Article 341 of the 2015 Criminal Code as amended by Clause 126, Article 1 of the Law amending the 2017 Criminal Code, which stipulates fabricating an organization's seal or documents and use thereof as follows:

1. Any person who fabricates an organization's seal or document or use it to commit an illegal act shall be liable to a fine of from VND 30,000,000 to VND 100,000,000 or face a penalty of up to 03 years' community sentence or 06 - 24 months' imprisonment.

2. This offence committed in any of the following circumstances carries a penalty of 02 - 05 years' imprisonment:

a) The offence is committed by an organized group;

b) The offence has been committed more than once;

c) The offence involves 02 - 05 fabricated seals or documents;

d) The fabricated seal or document is used to commit a less serious crime or a serious crime;

dd) The illegal profit earned is from VND 10,000,000 to under VND 50,000,000;

e) Dangerous recidivism.

3. This offence committed in any of the following circumstances carries a penalty of 03 - 07 years' imprisonment:

a) The offence involves ≥ 06 fabricated seals or documents;

b) The fabricated seal or document is used to commit a very serious crime or extremely serious crime;

c) The illegal profit earned is ≥ VND 50,000,000

4. The offender might also be liable to a fine of from VND 5,000,000 to VND 50,000,000.

Therefore, falsifying citizen identification cards can be prosecuted for criminal liability if they go beyond the administrative penalty framework in Vietnam. People who fake citizen identification cards can be imprisoned for up to 7 years. There may also be a fine from 5,000,000 VND to 50,000,000 VND.
