How much is fine for failure to keep motorbikes to the right lane in Vietnam? Can the police impound vehicles for failure to keep them to the right lane in Vietnam? What are regulations on operators of motorcycles in Vietnam?

Hi, I have a problem that needs to be answered. On October 31, I rode home by motorbike, but the distance was quite short, so I went in the opposite direction. Unfortunately, there was a policeman that day, so I was arrested and fined 400,000 VND. May I ask is this fine legal?

How much is fine for failure to keep motorbikes to the right lane in Vietnam?

Clause 3, Article 6 of Decree 100/2019/ND-CP is supplemented by Point b, Clause 4, Article 2 of Decree 123/2021/ND-CP providing for penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules:

3. A fine ranging from VND 400,000 to VND 600,000 shall be imposed upon a vehicle operator who commits any of the following violations:

a) Turning without slowing down or signaling (unless going along a curved segment where there is no level crossing);

b) Carrying 03 people or more on the vehicle;

c) Continuously honking, revving the engine in urban areas or residential areas, except for the emergency vehicles on duty;

d) Stopping or parking on a bridge;

dd) Going in groups in a manner that obstructs the traffic, except for the cases permitted by competent authorities;

e) Operating a vehicle that involves in an accident without stopping the vehicle, protecting the crash scene, or giving first aid to the victims, except for the violations specified in Point dd Clause 8 of this Article;

g) Failure to keep the vehicle to the right; going in the wrong lane; crossing the median strip; going on a sidewalk unless for entering a house;

h) Overtaking on the right side where prohibited;

i) Entering prohibited areas, roads erected with signs prohibiting entry of operated vehicles, except for violations specified in Clause 5, Point b Clause 6 of this Article and emergency vehicles on missions;

k) The operator’s or passenger’s pulling or pushing another vehicle or item while sitting on the vehicle; leading an animal or carrying a bulky object while sitting on the vehicle; standing on the seat, the cargo bracket, or sitting on the handle; loading cargo to the vehicle beyond permissible limits; towing another vehicle or object;

l) Exceeding the gross vehicle weight rating (GVWR) written on the Certificate of vehicle registration (if the GVWR is stated);

m) Failure to turn on low beam while operating the vehicle in a road tunnel.

n) Failure to wear a motorcycle helmet properly or wearing it improperly;

o) Carrying a person who does not wear a motorcycle helmet or does not wear the motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted

Thus, according to the above regulations in Vietnam, motorcyclists traveling in the opposite direction will be fined from VND 400,000 to VND 600,000. The fine level that the police have fined you is in accordance with the provisions of the law in Vietnam.

Can the police impound vehicles for failure to keep them to the right lane in Vietnam?

According to Clause 1, Article 82 of Decree 100/2019/ND-CP as amended by Point a, Clause 32, Article 2 of Decree 123/2021/ND-CP stipulating impounding vehicles and papers related to operators and vehicles at fault are as follows:

1. Pursuant to clauses 2 and 8 Article 125 of the Law on Penalties for Administrative Violations (amended in 2020), to immediately stop the violation, the person entitled to impose penalties is allowed to impound the vehicle before issuing a decision on to impose penalties for the offences specified in the following Articles, clauses and points of this Decree:

a) Point c clause 6; points a and c clause 8; clause 10 of Article 5;

b) Points b and c clause 6; point c clause 7; points a, b, c, d, e, g, h and i clause 8; clause 9 of Article 6;

c) Point c clause 6; point b clause 7; points a and b clause 8; clause 5 of Article 7;

d) Point q clause 1; point e clause 3; punts a, c, d and dd (if the violating vehicle operator is under 16 years of age), point g (if the violating vehicle operator is under 16 years of age) clause 4 of Article 8;

dd) Clause 9 of Article 11;

c) Points a and b clause 4; clause 5; points a, b and c clause 6 of Article 16;

g) Points a, b and c clause 2 of Article 17;

h) Points b and dd clause 1; points c, d, dd and e clause 2 of Article 19;

i) Clause 1; point a clause 4; clause 5; clause 6; clause 7; clause 8; clause 9 of Article 21;

k) Points dd, g, h and k clause 5; points b, e and h clause 8; points c and i clause 9; point b clause 10 of Article 30;

l) Point b clause 5 of Article 33.

Therefore, according to regulations on motorbikes traveling in the opposite direction, they are not one of the cases where the vehicle is temporarily impounded by the police in Vietnam.

What are regulations on operators of motorcycles in Vietnam?

Pursuant to Article 30 of the Law on Road Traffic 2008 stipulates that operators of and passengers on motorcycles and mopeds are as follows:

1. The operator of a motorcycle or moped may carry only one person, except for the following cases in which carrying two persons at most is permitted:

a/ Carrying sick persons for emergency medical treatment;

b/ Escorting a person who has committed an illegal act;

c/ Carrying children under 14 years of age.

2. The operators and passengers of motorcycles, three-wheeled motor vehicles or mopeds shall wear safety helmets, properly fastening their chin straps.

3. Operators of motorcycles, three-wheeled motor vehicles or mopeds are prohibited from:

a/ Traveling abreast;

b/ Traveling in road sections reserved for pedestrians and other vehicles;

c/ Using umbrellas, mobile phones and audible devices, except hearing aids;

d/ Pulling and pushing other vehicles or objects, and carrying bulky objects;

e/ Operating the vehicle without holding the handlebars or on one wheel, for two-wheeled vehicles, or on two wheels, for three-wheeled vehicles;

f/ Other acts badly affecting traffic order and safety.

4. Passengers of motorcycles, three-wheeled motor vehicles or mopeds in traffic are prohibited from:

a/ Carrying bulky objects;

b/ Using umbrellas;

c/ Clinging to, pulling or pushing other vehicles;

d/ Standing on the saddle or pillion, or sitting on the handlebars;

e/ Other acts baldy affecting traffic order and safety.

Above are the regulations for operators of motorcycles when participating in traffic in Vietnam.
