Hello, the other day I had to go back to my hometown so I borrowed my brother's car to get around. On the way home, I was stopped by the police for an administrative check. The police issued a penalty record for the error of the car inspection certificate being expired for 15 days but not re-registering it. Because this is a borrowed car, I don't pay attention to the inspection period. Please ask, if I am fined for a 15-day expired car inspection, how much will I be fined? This is my brother's car, will he be fined?

How much is fine for driving a car with an inspection certificate that has been expired for 15 days in Vietnam?

In Article 16 of Decree 100/2019/ND-CP amended by Clause 9, Article 2 of Decree 123/2021/ND-CP, regulations on penalties imposed upon by operators of motor vehicles (including trailers or semi-trailers being towed) and the like violating regulations on roadworthiness of vehicles as follows:

5. A fine ranging from VND 3,000,000 to VND 4,000,000 shall be imposed for any of the following offences:

a) Operating a vehicle with a certificate of technical and environmental safety inspection or technical and environmental safety inspection stamp that has expired for less than 01 month (including trailer and semi-trailer);

b) Operating a vehicle without a decent or functional and conformable brake system (including trailer and semi-trailer).

In addition, Clause 9, Article 2 of Decree 123/2021/ND-CP stipulates as follows:

8. Apart from incurring fines, the violating operator shall incur the following additional penalties:

a) The offence(s) specified in point a, point b clause 3; clause 4; clause 5; point c clause 6; point a clause 7 of this Article shall lead to suspension of the driver’s license from 01 - 03 months;

Thus, according to the law in Vietnam, when you drive a car with an expired inspection certificate of 15 days, you can be fined from 3,000,000 VND to 4,000,000 VND. In addition, your right to use your driver's license will be revoked from 01 month to 03 months.

Clause 8, Article 30 of Decree 100/2019/ND-CP stipulates penalties for vehicle owners who violate regulations related to road traffic as follows:

8. For owners of cars, tractors, heavy-duty vehicles and car-like vehicles: A fine ranging from VND 4,000,000 to VND 6,000,000 shall be imposed upon an individual, from VND 8,000,000 to VND 12.000.000 upon an organization that commits any of the following violations:

a) Using hired or borrowed car parts and accessories during inspection;

b) Operating a motor vehicle or heavy-duty vehicle on public roads with a certificate of technical and environmental safety or stamp of technical and environmental safety (if required) that has expired for less than 01 month (including those for trailers and semi-trailer);

c) Allowing an employee or representative to operate the vehicle committing any of the violations specified in Point b Clause 4 Article 24 hereof, or directly operating the vehicle committing any of the violations specified in Point b Clause 4 Article 24 hereof;

d) Allowing an employee or representative to operate the vehicle committing any of the violations specified in Point d Clause 6 Article 23; Point b Clause 5 Article 24 hereof, or directly operating the vehicle committing any of the violations specified in Point d Clause 6 Article 23; Point b Clause 5 Article 24 hereof;

dd) Operating vehicles that have exceeding service life, except for violations specified in Point I Clause 6 Article 28 hereof;

e) Operating vehicles with certificates of vehicle registration, certificates and stamps certifying technical and environmental safety of the vehicles issued by other than competent authorities or with modified certificates of vehicle registration; operating vehicles with certificates of vehicle registration inconsistent with chassis number of the vehicles (including trailers and semi-trailers);

g) Operating a vehicle without a license plate (if required); or the license plate of which is not consistent with the Certificate of vehicle registration or not issued by a competent authority (including trailers and semi-trailers);

h) Allowing an unqualified person according to Clause l Article 58 (in case of automobiles, tractors and car-like vehicles), Clause l Article 62 (in case of heavy-duty vehicles) of the Law on Road traffic to operate the vehicle on public roads (including those using an expired or revoked driving license or certificates of training in traffic rules);

i) Installing and using devices modifying license plates against regulations and law (including trailers and semi-trailers).

According to this Article, if you borrow your brother's car and have a inspection certificate that has expired for 15 days, your brother may be fined from 4,000,000 VND to 6,000,000 VND according to the law in Vietnam.

What are conditions for cars to join in road traffic in Vietnam?

In Clause 1, Article 53 of the 2008 Road Traffic Law, regulations on conditions for motor vehicles to join in road traffic are as follows:

1. Automobiles of proper types allowed to join in road traffic must satisfy the following quality, technical safety and environmental protection criteria:

a/ Being equipped with an effective brake system;

b/ Being fitted with an effective steering system;

c/ The steering wheel is on the left side of the automobile; for a foreigner’s overseas-registered automobile with a right-handed steering wheel, to join in road traffic in Vietnam, it must comply with the Government’s regulations;

d/ Being fully equipped with driving and passing lamps, registration plate lamp, stop lamp and signal lamps;

e/ Having the wheels fitted with pneumatic tires of the right size and right technical standards for each type of automobile;

f/ Having sufficient rear-view mirrors and other equipment and devices to ensure the operator’s visibility;

g/ Having the windscreen and windows made of safety glass;

h/ Having a horn of standard volume;

i/ Being fully equipped with an exhaust silencer, an exhaust pipe and other equipment and devices to ensure exhaust gas and noise up to environmental standards;

j/ Their structures are durable enough and ensure stable operation.

Above are conditions that must be met for cars to be allowed to participate in traffic according to the provisions of law in Vietnam.
