How are recordings with violent content penalized for circulation?
Based on Clause 3, Article 13 of Decree 38/2021/ND-CP, violations regarding the circulation of audio and video recordings with performing arts content are as follows:
A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for the act of circulating audio and video recordings containing content that incites violence; adversely affects foreign relations; uses costumes, language, sounds, images, gestures, means of expression, and forms of performance contrary to the nation's traditional customs and values; negatively impacts public ethics, community health, and social psychology.
Thus, in cases where video recordings with content inciting violence are circulated, a fine ranging from VND 30,000,000 to VND 40,000,000 will be imposed.
Note that this penalty applies to individuals who commit violations. In cases where organizations commit violations, the penalty will be double (Clauses 2 and 3, Article 5 of this Decree).
Moreover, it is mandatory to destroy cultural products with harmful content; confiscate illegal profits obtained; remove electronic video recordings from the internet and digital environments (Points b, c, d, Clause 5, Article 13 of this Decree).
