Handling Violations of the Law Regarding Voluntary Drug Treatment and Rehabilitation
How are violations of the law on voluntary drug treatment and rehabilitation handled?
Pursuant to Article 33 of Decree 116/2021/ND-CP, the handling of violations of the law on voluntary drug treatment and rehabilitation is prescribed as follows:
The Chairman of the People's Committee or the Head of the Commune Police shall make a record of the violation according to Form No. 27, Appendix II of this Decree as a basis for preparing a file to propose mandatory drug rehabilitation for the following cases:
a) Drug addicts who do not register for voluntary rehabilitation;
b) Individuals who have decisions for voluntary rehabilitation at home or in the community but do not undergo rehabilitation or arbitrarily terminate drug rehabilitation;
c) Individuals who use illegal drugs during the period of voluntary rehabilitation;
d) Drug addicts who do not comply with or arbitrarily terminate treatment when registered for opioid substitution therapy.
The dossier and procedure for proposing the application of mandatory rehabilitation measures shall be carried out in accordance with the provisions of Section 1, Chapter V of this Decree.
When is a certificate of completion of voluntary drug rehabilitation issued?
Pursuant to Clause 3, Article 32 of the above Decree on issuing certificates of completion of voluntary drug rehabilitation at home or in the community as follows:
Issuance of certificates of completion of voluntary drug rehabilitation at home or in the community:
a) Upon the expiration of the voluntary rehabilitation period, the person assigned to monitor and manage the rehabilitant shall evaluate the voluntary rehabilitation results and propose the Chairman of the People's Committee at the commune level to issue a certificate of completion of voluntary drug rehabilitation at home or in the community;
b) The certificate of completion of voluntary drug rehabilitation at home or in the community shall be issued according to Form No. 26a, Appendix II of this Decree. One copy shall be sent to the drug rehabilitant, the rehabilitant's family (for individuals aged 12 to under 18), and one copy shall be sent to the Commune Police to carry out post-rehabilitation management.
