From January 1, 2025, will drivers with 12 demerit points be disqualified from driving? What is the age requirement for drivers operating vehicles in road traffic? Who is eligible for training to upgrade their driver's license?

From January 1, 2025, drivers with 12 points will not be allowed to drive if all points are deducted?

Based on Article 58 of the 2024 Law on Road Traffic Order and Safety, the points on a driver's license are regulated as follows:

Points on a driver's license

  1. The points on a driver's license are used to manage compliance with the law on road traffic order and safety of drivers on the database system of road traffic order and safety, including 12 points. The points deducted for each violation depend on the nature and severity of the act of violating the law on road traffic order and safety. Data on the deduction of points from the driver's license of the violator will be updated in the database system immediately after the enforcement decision takes effect and will be notified to the person whose license points are deducted.

  2. In cases where the driver's license is fully deducted of points, the holder of the driver's license is not allowed to operate vehicles participating in road traffic according to that driver's license. After a period of at least 6 months from the date the points are fully deducted, the holder of the driver's license may participate in the examination of knowledge on the law of road traffic order and safety as prescribed in clause 7 of Article 61 of this Law organized by the Traffic Police force, and if they achieve the required results, the 12 points will be fully restored.

  3. A driver's license that is renewed, reissued, or upgraded retains the points from the previous license before renewal, reissuance, or upgrading.

  4. Authorized administrative sanctioning officials have the authority to deduct points from the driver's license.

  5. The Government of Vietnam provides detailed regulations on clause 1 of this Article; provides regulations on the procedures, authority to deduct points, and restore points on a driver's license; and outlines the implementation roadmap for this Article. The Minister of Public Security provides detailed regulations on clause 3 of this Article.

According to the above regulations, from January 1, 2025, drivers will have 12 points on their driver's licenses used to manage compliance with the law on road traffic order and safety on the database system of road traffic order and safety.

The points on the driver's license will be deducted each time a violation occurs, depending on the nature and severity of the violation of the law on road traffic order and safety.

In cases where the driver's license is fully deducted of points, the holder of the driver's license is not allowed to operate vehicles participating in road traffic according to that driver's license.

What are the age requirements for drivers operating vehicles participating in road traffic?

Based on Article 59 of the 2024 Law on Road Traffic Order and Safety, the age requirements for drivers are as follows:

- Individuals who are at least 16 years old are allowed to operate motorbikes.- Individuals who are at least 18 years old are granted a class A1, A, B1, B, or C1 driver's license and are granted a certificate of training in the knowledge of road traffic law to operate specialized machinery participating in road traffic.- Individuals who are at least 21 years old are granted a class C or BE driver's license.- Individuals who are at least 24 years old are granted a class D1, D2, C1E, or CE driver's license.- Individuals who are at least 27 years old are granted a class D, D1E, D2E, or DE driver's license.- The maximum age for drivers of passenger cars (including buses) with more than 29 seats (not including the driver's seat), and sleeper buses, is 57 years for men and 55 years for women.

Who is subject to the training for upgrading a driver's license?

Based on Article 60 of the 2024 Law on Road Traffic Order and Safety, the training for upgrading a driver's license applies to the following subjects:

- Upgrading a driver's license from class B to class C1 or to class C or to class D1 or to class D2- Upgrading a driver's license from class C1 to class C or to class D1 or to class D2- Upgrading a driver's license from class C to class D1 or to class D2 or to class D- Upgrading a driver's license from class D1 to class D2 or to class D- Upgrading a driver's license from class D2 to class D- Upgrading a driver's license from class B to class BE, from class C1 to class C1E, from class C to class CE, from class D1 to class D1E, from class D2 to class D2E, from class D to class DE
