Failure to Register Temporary Residence: Are the Landlord or Tenant Subject to Fines?

Based on point a, clause 1, Article 8 of Decree No. 167/2013/ND-CP, individuals and heads of households who do not comply with temporary residence registration requirements will be fined from VND 100,000 to VND 300,000.

Additionally, under clause 4, Article 23 of the Law on Handling Administrative Violations 2012, the specific fine amount for an administrative violation is the average of the fine range prescribed for that violation.

If there are mitigating circumstances, the fine may be reduced but not below the minimum of the fine range; if there are aggravating circumstances, the fine may increase but not exceed the maximum of the fine range.

Accordingly, under the above regulations, both the landlord and the tenant will be penalized if they do not comply with temporary residence registration requirements.
