Failure to Ensure Maintenance of One of the Conditions for Opening a Training Course, Major: Penalties?

According to Clauses 2c, 3, and 4a, Article 12 of Decree 04/2021/ND-CP (Effective from March 10, 2021), the content is stipulated as follows:

A fine ranging from 20,000,000 VND to 40,000,000 VND shall be imposed for any of the following acts:

Failure to ensure the maintenance of any conditions that have been stipulated for the opening of training programs or specializations according to current legal provisions.

Additional form of penalty: Suspension of educational activities for the program or specialization from 06 months to 12 months for the violation stipulated at Point c Clause 2 of this Article.

Remedial measures:

Mandatory transfer of students who meet the admission conditions and have enrolled to another educational institution that meets the conditions permitted to conduct educational activities, or cancellation of the admission decision and refund of collected fees to students if a transfer cannot be made for the violation stipulated at Clause 2 of this Article.

Note: The aforementioned fines are the penalties imposed for the administrative violations committed by organizations. For the same administrative violations, the fines for individuals shall be half of the fines imposed on organizations.
