Exploiting Fishery Resources Exceeding Permitted Yield by 7%: Penalty Amount?
According to the provisions of Article 22 of Decree 42/2019/ND-CP on violations of the fishing quota, it is stipulated that:
A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for fishing activities that exceed 10% to less than 20% of the permitted quota.
A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed for fishing activities that exceed 20% to 30% of the permitted quota.
A fine ranging from VND 40,000,000 to VND 50,000,000 shall be imposed for fishing activities that exceed 30% or more of the permitted quota.
Thus, according to the above provisions, penalties will only be imposed for fishing activities that exceed 10% or more of the allowed quota. Activities that exceed less than 10% will not be penalized. Therefore, in the case of fishing activities that exceed 7% of the allowed quota, there will be no penalty.
