Do traffic polices have to witness to stop vehicles in Vietnam? What requirements must be met when stopping and controlling motorbikes in Vietnam?
I have a question I hope to get answered: Normally, traffic police stop pedestrians when they witness the violator's mistake, but there are also cases where they don't see it directly but still stop the correct vehicle. So I want to ask, do I have to see it with my own eyes to stop a vehicle? And when stopping the vehicle, what must the control ensure? Thank you!

Pursuant to Clause 1, Article 16 of Circular 65/2020/TT- BCA regulations on stopping vehicles for control as follows:
1. Traffic police performing patrol and control tasks according to plan may stop vehicles for control in the following cases:
a) Directly detect or through means and professional technical equipment detect and record violations of road traffic laws and other violations of law;
b) Implement orders, plans for general control of road vehicles, plans for patrolling, controlling, and handling violations according to topics approved by competent authorities;
c) There is a written request from the Head or Deputy Head of the investigation agency; Written request from relevant authorities to stop traffic vehicles for control to ensure security and order, fight against crime and other violations of the law. The written request must specify the time, route, means of transport stopped for control and handling, and the forces involved in coordination;
d) Information, feedback, recommendations, and denunciations from organizations and individuals about violations of the law by people and vehicles participating in road traffic.
Therefore, directly detecting violations is one of the conditions for stopping the vehicle, besides there are many other reasons such as detecting and recording violations through means and professional technical equipment to detect and record violations of law; News, feedback, recommendations, denunciations of organizations, individuals... according to the above regulations in Vietnam.
What requirements must be met when stopping and controlling motorbikes in Vietnam?
Pursuant to Clause 2, Article 17 of Circular 65/2020/TT- BCA, it is necessary to ensure the following requirements when stopping and controlling a vehicle:
2. Stopping and controlling traffic vehicles must ensure the following requirements:
a) Safe, in accordance with the law, does not obstruct traffic activities. Once the vehicle has stopped, it is necessary to control and handle violations (if any) according to the provisions of law;
b) When stopping or controlling at a point, at a Traffic Police Station, the requirements specified in Point a of this Clause and the following requirements must be met:
Place barriers with cone-shaped cones or ropes along the road in the road, lane close to the curb or sidewalk to form an area to ensure traffic order and safety according to regulations of the Ministry of Public Security on implementing democracy in ensuring traffic order and safety. Minimum barrier length is 100m for highways, 50m for national highways and 30m for provincial roads, district roads, urban roads, commune roads and specialized roads;
Areas ensuring traffic order and safety must comply with the provisions of law on road traffic and other relevant laws; Sufficient area to arrange and install technical and professional means and equipment, control and handle traffic violations; Arrange traffic police to guide, regulate traffic, and ensure traffic safety. In case of control on the highway, sign number 245a "Go slowly" or sign number 245b (for external routes) must be placed in front of the Traffic Police Team in the direction of the vehicle that needs to be controlled according to the provisions of the law on road signs;
c) When stopping and controlling vehicles on the highway, the requirements specified in Points a and b of this Clause and the following requirements must be met:
When controlling at a point, traffic vehicles can only be stopped to control and handle violations at the following locations: Toll station area, starting and ending points of the expressway;
When patrolling and mobile control, vehicles are only allowed to stop in the emergency vehicle stopping lane to control and handle violations in the following cases: Detecting serious and dangerous violations of traffic order and safety; coordinate the fight against crime; reporting and denouncing illegal acts of people and vehicles traveling on the highway; detect vehicles stopping or parking illegally on the highway. When the incident is resolved, the traffic poles, ropes, and signs must be cleaned up and moved immediately.
