Definition of Recidivism in Administrative Violations
Based on Clause 1, Article 1 of the amended Law on Handling Administrative Violations 2020 (effective from January 1, 2022), the definition of recidivism is as follows:
Recidivism is when an individual or organization, having already been issued a decision on administrative violation penalties but the period during which it is considered as not having been penalized for administrative violations has not yet expired, commits the same administrative violation for which they were penalized; or when an individual who has already been issued a decision on measures to handle administrative violations but the period during which it is considered as not having been subjected to administrative handling measures has not yet expired, commits an act subject to those administrative handling measures again.
