Damaging someone else's property results in an administrative fine of 3.5 million VND, how long until the criminal record is expunged?
Clause 1, Article 7 of the Law on Handling Administrative Violations 2012 stipulates the period considered as not having been subject to administrative handling:
Individuals and organizations that are administratively sanctioned, if within 06 months from the date of completing the decision on warning sanction or 01 year from the date of completing the administrative sanction decision other than or from the expiration date of the statute of limitations for executing the administrative sanction decision without reoffending, are considered as not having been administratively sanctioned.
...
Thus, in the case of administrative violations, if a decision is made to impose a monetary fine, it is considered that within 01 year from the date of completing the monetary fine decision and not reoffending, it is considered as not having been administratively sanctioned.
Therefore, in the case of damaging others’ property and being fined 3.5 million VND, one year after paying the fine, if there is no reoffense, it is considered as not having been administratively sanctioned (no longer having administrative penalties).
