Can Economic Police Officers on Duty Impose Administrative Penalties for Traffic Violations?
Are police officers on duty allowed to impose administrative penalties for traffic violations?
According to Clause 1, Article 76 of Decree 100/2019/ND-CP which stipulates the administrative penalties in the field of road and railway traffic, it is provided:
- On-duty People's Police officers have the authority:
a) To issue a warning;
b) To impose fines up to 400,000 VND for violations in the field of road traffic and 500,000 VND for violations in the field of railway traffic.
=> Therefore, according to the regulations on administrative penalties for traffic violations, if a police officer is on duty (including economic police and mobile police) and discovers a violation by an individual, they are authorized to issue a warning or impose a fine up to 400,000 VND for road traffic violations and up to 500,000 VND for railway traffic violations.
Can they fine the violation of not using turn signals?
At Point a, Clause 3 of Article 6 of Decree 100/2019/ND-CP, it is stipulated:
A fine ranging from 400,000 VND to 600,000 VND shall be imposed on motorcycle and moped drivers (including electric motorcycles) and similar vehicles for any of the following violations:
- Changing directions without reducing speed or without signaling (except when driving in a curved section of the road where the roads do not intersect on the same level);
According to the above regulations, if the police or traffic officers on duty detect a motorcycle changing direction without using turn signals, they are authorized to impose a fine of 400,000 VND.
