Please ask, my brother is 17 years old, last week he went to a wedding and used alcoholic beverages. So, with my brother's case, will he be punished in Vietnam?
Are there penalties for persons aged under 18 for consumption of alcoholic beverages in Vietnam?
According to the provisions of Article 30 of Decree 117/2020/ND-CP on violations against regulations on consumption of alcoholic beverages and places where alcoholic beverage consumption is not allowed as follows:
1. A warning or a fine ranging from VND 200.000 to VND 500.000 shall be imposed upon a person aged from 16 to under 18 for consumption of alcoholic beverages.
2. A fine ranging from VND 500.000 to VND 1.000.000 shall be imposed for commission of one of the following violations:
a) Consuming alcoholic beverages at places where the alcoholic beverage consumption is not allowed;
b) Inciting or persuading others to consume alcoholic beverages.
3. A fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed for commission of one of the following violations:
a) Consuming alcoholic beverages before or during working or learning hours or break times;
b) Forcing others to consume alcoholic beverages.
Thus, in the case of your brother, who is currently 17 years old, who consumes alcoholic beverages in Vietnam, he will be warned or fined from 200,000 VND to 500,000 VND.
