Are there penalties for parking cars on pedestrian crossings in Vietnam? How much is fine for parking cars on pedestrian crossings in Vietnam? What are cases of carriage of persons on cargo vehicles in Vietnam?

Hi, I have a problem that needs to be answered. On November 16, I parked my car on pedestrian crossings about 3m to run into a friend's house to get things. As soon as I got back to the car, I was fined by the police for parking on pedestrian crossings, I was fined 800,000 VND. Can I ask if parking on pedestrian crossings is also fine and is the amount I fined correct?

Are there penalties for parking cars on pedestrian crossings in Vietnam?

In Clause 4, Article 18 of the 2008 Road Traffic Law, standing and parking on roads:

4. It is forbidden to stand or park a vehicle at the following positions:

a/ On the left side of one-way carriages;

b/ On bends and close the crests of slopes with insufficient visibility;

c/ On bridges, under flyovers;

d/ In parallel with another standing or parked vehicle;

e/ On pedestrian crossings;

f/ At an intersections and within 5 meters from the edge of the intersection;

g/ At bus stops;

h/ In front of and within 5 meters from both sides of the entrances of offices of agencies or organizations;

i/ At road sections wide enough for only line of traffic;

j/ Within railroad tracks’ safety areas;

k/ At places where the vehicle would conceal road signs.

Thus, according to the regulations on pedestrian crossings in Vietnam that is considered an pedestrian crossings, you have parked your car close to the pedestrian crossings 3m (within 5m from the pedestrian crossings). According to this Article, your act of parking your car near the pedestrian crossings of 3m is breaking the law, the police sanctioning you is in accordance with the law.

How much is fine for parking cars on pedestrian crossings in Vietnam?

In Clause 3, Article 5 of Decree 100/2019/ND-CP as amended by Article 2 of Decree 123/2021/ND-CP stipulating penalties imposed upon operators of cars and car-like vehicles violating traffic rules are as follows:

3. A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed upon a vehicle operator who commits any of the following violations:

a) Exceeding the speed limits by from 5 km/h to under 10 km/h;

b) Continuously honking, revving up the engine, using air horns or high beam in an urban area or residential area, except for emergency vehicles on duty;

c) Turning without slowing down or signaling (unless going along a curved segment where there is no intersection);

d) Failure to obey the regulations on stopping or parking at intersection with the railway; stopping or parking within the railway safety perimeter, except for the violations specified in Point b Clause 2, Point b Clause 3 Article 49 hereof;

dd) Stopping or parking on the left side of a one-way road, on a curved road or near the top of the slope where view is blocked, on a bridge, under an overpass, parallel to a stopping or parking vehicle, at an intersection within 05 m from the edge of the intersection, at a bus stop, in front of or within 05 m beside a gate of an organization that has car way, on a road that is wide enough for only one lane; stopping or parking in a manner that block road signs; stopping or parking at median barriers;

e) Failure to stop the vehicle close to the sidewalk on the right side, or the distance from the right wheel to the sidewalk exceeds 0.25 m; stopping on the tramway or bus lane; stopping right above a manhole, cable duct opening, at a fire hydrant; parking on the sidewalk against the law; parking where a “Cấm đỗ xe” (No parking) sign or “Cấm dừng xe và đỗ xe” (No stopping and parking) sign is erected, except for the violations specified in Point i Clause 4 and Point b Clause 6 of this Article;

Therefore, according to regulations in Vietnam, cars parked near pedestrian crossings within 5m will be fined from VND 800,000 to VND 1,000,000. The amount that the traffic police fines you is in accordance with the law.

What are cases of carriage of persons on cargo vehicles in Vietnam?

Pursuant to Article 21 of the Law on Road Traffic 2008 stipulates cases of carriage of persons on cargo vehicles as follows:

1. Persons may only be carried on cargo vehicles in the following cases:

a/ Carrying persons to perform natural disaster prevention and combat tasks or urgent tasks; carrying people’s armed force officers and soldiers to perform their duties; carrying victims to hospital;

b/ Carrying road maintenance and repair workers; carrying learner drivers on driving practice cars; carrying persons forming a procession;

c/ Evacuating persons out of dangerous areas or in other cases of emergency as prescribed by law.

2. Vehicles carrying persons in the cases specified in Clause 1 of this Article must have a fixed trunk, ensuring traffic safety.

The above are cases in which people are allowed to be carried on cargo vehicles as prescribed by law in Vietnam.
