Are there penalties for carrying materials without an effective cover in Vietnam? I carry construction sand by car because it's sunny, so if I don't cover up, will I be fined or not?
Are there penalties for carrying materials without an effective cover in Vietnam?
Pursuant to Clause 1, Article 72 of the 2008 Law on Road Traffic, there are regulations on cargo transportation by car as follows:
1. The transportation of goods by car must comply with the following provisions:
a/ Cargoes transported on cars must be tidily arranged and securely tied up;
b/ When transporting unpackaged cargo, to cover them and not to let them drop on the road.
According to Clause 2, Article 20 of Decree No. 100/2019/ND-CP stipulating penalties incurred by operators of cars, tractors and car-like vehicles violations against regulations on environmental protection as follows:
2. A fine ranging from VND 2,000,000 to VND 4,000,000 shall be imposed for:
a) Spilling oil or chemicals on public roads;
b) Carrying break bulk cargo, wastes or building materials that are likely to be spilled without a cover or an effective cover; spilling water from goods or waste being carried threatening traffic safety and environmental hygiene;
c) Dragging mud, dirt, sand, materials or other wastes on public roads threatening traffic safety and environmental hygiene.
Thus, according to regulations in Vietnam, construction sand can be considered as bulk cargo and construction materials, sand is easy to drop, so when transporting sand you need to have an effective cover.
In this case, you may be fined from VND 2,000,000 to VND 4,000,000 for your behavior in Vietnam. In addition, if you spill sand on the road, you may be required to clean up to restore the original condition of the road.
