Are riding motorcycles carrying three people without helmets sanctioned in Vietnam?
My family had a sick grandmother the other day, so we had to take her to the hospital urgently, because I could not call an ambulance, so my father decided to drive her to the hospital by motorbike, I had to go with her to help her. When we were in such a hurry, we didn't wear a helmet, fortunately we didn't see the police on the road. May I ask, in case of arrest by the traffic police in Vietnam, will we be sanctioned? Pursuant to Clause 1, Article 30 of the Road Traffic Law 2008, it is stipulated:
1. The operator of a motorcycle or moped may carry only one person, except for the following cases in which carrying two persons at most is permitted:
a/ Carrying sick persons for emergency medical treatment;
b/ Escorting a person who has committed an illegal act;
c/ Carrying children under 14 years of age.
At the same time, Point k, Clause 2, Article 6 of Decree 100/2019/ND-CP also provides as follows:
2. A fine ranging from VND 200,000 to VND 300,000 shall be imposed upon a vehicle operator who commits any of the following violations:
k) Carrying a passenger who does not wear a motorcycle helmet properly, unless that person is a patient who needs urgent medical care, a child under 06 years of age, or a criminal being escorted;
Thus, in this case, the grandmother needs urgent medical care. According to the above regulations, the act of carrying 3 people of your family will be in the case of carrying the sick person to the emergency in Vietnam. So, there's no punishment for meeting the traffic police.
