Are Pedestrians Subject to Penalty for Crossing During a Yellow Light?
Based on Point c, Clause 3, Article 10 of the 2008 Road Traffic Law regarding traffic signals with three colors as follows:
The yellow signal means you must stop before the stop line, except in cases where you have already crossed the stop line, you may continue; in the case of a flashing yellow signal, you are allowed to proceed but must reduce speed, be attentive, and yield to pedestrians crossing the road.
Simultaneously, the National Technical Regulation on Road Signs No. 41:2019/BGTVT issued together with Circular 54/2019/TT-BGTVT also provides similar explanations as follows:
+ The yellow signal indicates a change of signal from green to red. When the yellow signal is on, you must stop before the stop line; in cases where you have already crossed the stop line or are too close to the stop line and stopping would pose a danger, you may continue.
+ In the case of a flashing yellow signal, you are allowed to proceed but must reduce speed, be attentive, and yield to pedestrians crossing the road or other vehicles as stipulated by the Road Traffic Law.
According to Point b, Clause 1, Article 9 of Decree 100/2019/ND-CP, pedestrians who cross during a yellow signal will be fined from 60,000 VND to 100,000 VND.
Thus, according to the above regulation, pedestrians who cross during a yellow signal can still be fined with the aforementioned penalty.
