Are Overloaded Motorcycles Allowed in Traffic?
Section 4, Article 19 of Circular 46/2015/TT-BGTVT stipulates the width and length for loading goods on road vehicles when commuting on roads concerning motorcycles and motorbikes as follows:
Goods and luggage must not extend beyond each side of the cargo rack's width as per the manufacturer's design by more than 0.3 meters, and must not extend beyond the rear of the cargo rack by more than 0.5 meters. The height of loaded goods measured from the road surface must not exceed 1.5 meters.
Section 3k, Article 6 of Decree 100/2019/ND-CP prescribes that a fine ranging from 400,000 VND to 600,000 VND will be imposed on individuals who commit any of the following violations while operating a vehicle:
Drivers who are operating a vehicle or carrying a person who is clinging to, pulling, pushing another vehicle or object, leading an animal, carrying bulky items, carrying someone standing on the seat, cargo rack, or sitting on the handlebars; loading goods on the vehicle beyond the stipulated limits; towing another vehicle or object.
Thus, in the case where a motorcycle driver carries bulky goods that exceed the specified dimensions, a fine ranging from 400,000 VND to 600,000 VND may be imposed.
Additionally, in the event of causing a traffic accident, the driver's license may be revoked for a period ranging from 2 months to 4 months (Section 10c).
