How many days of holiday are employees in Vietnam entitled to during the Lunar New Year in 2025?
Pursuant to Article 112 of the Labor Code 2019 regarding holidays:
Article 112. Public holidays
- Employees are entitled to fully paid days off on the following public holidays and Tet:
a) New Year's Day: 01 day (January 1 according to the solar calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 according to the solar calendar);
d) International Labor Day: 01 day (May 1 according to the solar calendar);
e) National Day: 02 days (September 2 according to the solar calendar and 01 day adjacent before or after);
f) Hung Kings' Commemoration Day: 01 day (March 10 according to the lunar calendar).
- Foreign workers in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to an additional 01 day off on their country's traditional New Year and 01 day off on their National Day.
- Annually, based on practical conditions, the Prime Minister of the Government of Vietnam specifically decides the holidays mentioned in points b and e, Clause 1 of this Article.
On November 26, 2024, the Office of the Government of Vietnam issued Official Dispatch 8726/VPCP-KGVX of 2024 on the Lunar New Year holiday and some public holidays in 2025.
For Lunar New Year 2025, employees are entitled to the following days off:
- For officials and public employees: The Lunar New Year 2025 holiday will be from January 25, 2025 to the end of February 2, 2025, totaling 9 days.
- For employees: Employees are granted 5 days off for Lunar New Year 2025 as per the 2019 Labor Code.
However, in 2025, the 5 official days off are immediately preceded by a weekend, Saturday and Sunday, January 25-26, 2025. Following the official holidays are another weekend, Saturday and Sunday, February 1-2, 2025.
Thus, employees will have a continuous 9-day break for the Lunar New Year 2025, from Saturday, January 25, 2025, to the end of Sunday, February 2, 2025.
Additionally, the Ministry of Labor, War Invalids and Social Affairs encourages enterprises to follow the holiday schedule for Lunar New Year in 2025 mentioned above for their employees.
In which cases can employees in Vietnam take personal leave with full pay?
Pursuant to Article 115 of the Labor Code 2019 on personal leave, unpaid leave:
Article 115. Personal leave, unpaid leave
- Employees are entitled to take personal leave with full pay and must notify the employer in the following cases:
a) Marriage: 03 days off;
b) Biological or adopted child's marriage: 01 day off;
c) Death of biological father, mother, adoptive father, adoptive mother, father-in-law, mother-in-law, spouse; death of biological or adopted child: 03 days off.
- Employees are entitled to 01 unpaid day off and must inform the employer in case of the death of a grandparent, sibling, or in-law's marriage; parent's remarriage; siblings' marriage.
- In addition to provisions in Clauses 1 and 2 of this Article, employees may negotiate with their employer for unpaid leave.
According to the above regulation, employees are entitled to take personal leave with full pay for the following occasions:
- Marriage: 03 days off
- Biological or adopted child's marriage: 01 day off
- Death of biological father, mother, adoptive father, adoptive mother, father-in-law, mother-in-law, spouse; death of biological or adopted child: 03 days off.
Note: Employees must notify employers when taking personal leave with full pay.
