What are regulations on salaries of employees when they work during Lunar New Year in 2025 in Vietnam?

Based on Article 112 of the Labor Code 2019 stipulating holidays:

Article 112. Holidays

  1. Employees are entitled to take leave, enjoying full pay on the following holidays:

a) New Year's Day: 01 day (January 01, Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30, Gregorian calendar);

d) International Labor Day: 01 day (May 01, Gregorian calendar);

e) National Day: 02 days (September 02, Gregorian calendar, and 01 day immediately before or after);

f) Hung Kings' Ancestor Death Anniversary: 01 day (March 10, Lunar calendar).

  1. Foreign employees in Vietnam, in addition to the holidays provided in clause 1 of this Article, are also entitled to 01 additional day for their traditional New Year and 01 day for their national day.
  1. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides the specific holidays stipulated at points b and e of clause 1 of this Article.

Based on Article 98 of the Labor Code 2019 regarding overtime wages and night work:

Article 98. Overtime, night work wages

  1. Employees working overtime are paid wages based on the salary unit price or the actual salary paid for the current job as follows:

a) On regular days, at least 150%;

b) On weekly days off, at least 200%;

c) On holidays, Lunar New Year, paid leave days, not less than 300%, not including the salary of the holiday, Lunar New Year, paid leave for employees paid on a daily basis.

  1. Employees working at night are paid at least 30% more based on the salary unit or the actual salary paid for work on a regular day.
  1. Employees working overtime at night, in addition to being paid as prescribed in clauses 1 and 2 of this Article, are also paid an additional 20% of the salary calculated on the salary unit or the actual salary for work done during the day of a regular day, weekend day, or holiday, Lunar New Year.
  1. The Government of Vietnam provides detailed regulations on this Article.

According to the above regulations, for Lunar New Year 2025, employees are entitled to take leave for 05 days and enjoy full pay. Thus, employees working on the Lunar New Year are paid as follows:

If employees work overtime on holidays, Lunar New Year, they will receive full pay for that day and at least 300% of the holiday, Lunar New Year salary. (At least 400% per day).

For employees working overtime at night on holidays, Lunar New Year, in addition to being paid overtime for the holiday, Lunar New Year, night work wages, they are also paid an additional 20% of the salary X the actual pay according to daytime work for the Lunar New Year holiday (300%) = At least 490% per day.

How many minutes will the fireworks display last during Lunar New Year in 2025 in Vietnam?

Based on clause 1 Article 11 of Decree 137/2020/ND-CP regulating cases of organizing fireworks:

Article 11. Cases of organizing fireworks

  1. Lunar New Year

a) Central-affiliated cities and Thua Thien Hue province are allowed to display high-altitude and low-altitude fireworks, duration not exceeding 15 minutes; other provinces are allowed to display low-altitude fireworks, duration not exceeding 15 minutes;

b) The time of display is at the turn of the Lunar New Year.

  1. Hung Kings' Ancestor Death Anniversary

a) Phu Tho province is allowed to display low-altitude fireworks, duration not exceeding 15 minutes, place at the Hung Temple area;

b) The time of display is at 21:00 on March 09, Lunar calendar.

Thus, the duration of fireworks display for the Lunar New Year 2024 is a maximum of 15 minutes; for central-affiliated cities and Thua Thien Hue province, both high-altitude and low-altitude fireworks are permitted. Other provinces may only display low-altitude fireworks.
